{"id":322179,"date":"2024-05-15T12:00:55","date_gmt":"2024-05-15T06:30:55","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=322179"},"modified":"2024-05-18T11:28:16","modified_gmt":"2024-05-18T05:58:16","slug":"arbitration-award-cannot-be-set-aside-on-erroneous-application-of-law-unless-it-is-patently-illegal-allahabad-high-court-reiterates","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/05\/15\/arbitration-award-cannot-be-set-aside-on-erroneous-application-of-law-unless-it-is-patently-illegal-allahabad-high-court-reiterates\/","title":{"rendered":"Arbitration award cannot be set aside on erroneous application of law unless it is patently illegal: Allahabad High Court reiterates"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Allahabad High Court<\/span>: In an appeal filed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544942\" target=\"_blank\" rel=\"noopener\">37<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726958\" target=\"_blank\" rel=\"noopener\">Arbitration and Conciliation Act, 1996<\/a> (&#8216;the Act&#8217;) for setting aside the order passed by the Commercial Court, wherein the Court upheld the arbitrator&#8217;s award, <span style=\"font-weight: bold;\">Arun Bhansali, J.<\/span> and <span style=\"font-weight: bold;\">Vikas Budhwar, CJ.<\/span>, while upholding the decision of the Commercial Court, observed that an award is not &#8216;patently illegal&#8217; for mere erroneous application of law or appreciation of evidence.<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">The underlying dispute originated from a contractual agreement for Water Borne Sanitation work in Meerut. Despite the initial completion period of 12 months, which was extended, disputes emerged between the parties regarding various aspects of the contract, prompting arbitration. The arbitrator, appointed in accordance with the agreement, rendered a decision in favour of the respondent.<\/p>\n<p style=\"margin-bottom: 3%;\">The said award passed by the sole arbitrator was challenged under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544939\" target=\"_blank\" rel=\"noopener\">34<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726958\" target=\"_blank\" rel=\"noopener\">Act<\/a> by the respondent before the Commercial Court, which was rejected, upholding the award passed by the sole arbitrator. The dispute between parties was on the point of whether the issue of escalation of wages, amongst other issues, was arbitrable.<\/p>\n<p style=\"font-weight: bold;\">Analysis and Decision<\/p>\n<p style=\"margin-bottom: 3%;\">Upon examination, the Court delved into the provisions of Clause 6(A) of the General Conditions of Contract (GCC) and determined that it primarily pertained to discrepancies and adjustments related to contractual documents, rather than a wage escalation dispute. The Court noted the absence of evidence demonstrating variations or conflicting provisions in the contract that would preclude arbitration of wage escalation issues. Additionally, the Court dismissed the relevance of post-contract correspondence, deeming it temporally disconnected from the execution of the contract.<\/p>\n<p style=\"margin-bottom: 3%;\">In assessing the scope of intervention under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544942\" target=\"_blank\" rel=\"noopener\">37<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726958\" target=\"_blank\" rel=\"noopener\">Act<\/a>, the Court emphasized the requirement for an award to exhibit patent illegality warranting intervention and noted that mere errors in the application of law or appreciation of evidence are insufficient grounds for setting aside an award. The Court referred to precedents, such as <span style=\"font-style: italic;\">MMTC Ltd.<\/span> v. <span style=\"font-style: italic;\">Vedanta Ltd.<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/03IO7fGQ\" target=\"_blank\" rel=\"noopener\">(2019) 4 SCC 163<\/a>; <span style=\"font-style: italic;\">Ssangyong Engg. &amp; Construction Co. Ltd.<\/span> v. <span style=\"font-style: italic;\">NHAI<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/6IZ1OO4v\" target=\"_blank\" rel=\"noopener\">(2019) 15 SCC 131<\/a>, to reaffirm this principle.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court, therefore, held that the arbitrator&#8217;s award does not manifest patent illegality that warranted intervention. Consequently, the Court upheld the decision of the Commercial Court and dismisses the appellant&#8217;s appeal.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Union Of India Through Garrison Engineer v.
