{"id":321743,"date":"2024-05-09T10:30:57","date_gmt":"2024-05-09T05:00:57","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=321743"},"modified":"2024-05-09T10:36:30","modified_gmt":"2024-05-09T05:06:30","slug":"rbi-notifies-foreign-exchange-management-deposit-regulations-2024-legal-news","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/05\/09\/rbi-notifies-foreign-exchange-management-deposit-regulations-2024-legal-news\/","title":{"rendered":"Foreign Exchange Management (Deposit) (Fourth Amendment) Regulations, 2024"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 06-05-2024, the Reserve Bank of India amended the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002848806\" target=\"_blank\" rel=\"noopener\">Foreign Exchange Management (Deposit) Regulations, 2016<\/a> (&#8216;Principal Regulations&#8217;) through powers conferred by Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558436\" target=\"_blank\" rel=\"noopener\">47(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002806288\" target=\"_blank\" rel=\"noopener\">Foreign Exchange Management Act, 1999<\/a>. The amendment shall be called the Foreign Exchange Management (Deposit) (Fourth Amendment) Regulations, 2024. It shall be come into effect from 06-05-2024.<\/p>\n<p style=\"font-weight: bold;\">Key Points:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Sub-regulation 6 has been inserted providing that an authorized dealer in India can allow a person who resides outside India, and who has entered into a permitted derivative contract to open, hold, and maintain an interest-bearing account in either Indian or Foreign currency for posting and collecting margin in India.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">The permitted derivative contract entered into by the above-mentioned person should be in terms of Foreign Exchange Management (Margin for Derivative Contracts) Regulations, 2020 as amended from time to
