Supreme Court:<\/span> In a matter concerning the termination of pregnancy of a 14-year-old rape survivor, the three- judge bench of Dr. DY Chandrachud,CJI., JB Pardiwala and Manoj Misra JJ. has recalled its earlier directions permitting the termination of the pregnancy. The Bench reversed its order after the parents of the girl raised health-related concerns for the minor.<\/p>\n

In its 22-04-2024 order<\/a>, the Court invoked power under Art. 142<\/a> of Constitution<\/a> to allow abortion of 14-year-old rape survivor.The Court had directed the Dean at Sion Hospital to immediately constitute a team for undertaking the medical termination of pregnancy of the minor.<\/p>\n

The Bench after having a discussion in chambers with the parents of the minor, said that the reversal was needed as the ‘interest of the child is paramount’.<\/p>\n
