Madhya Pradesh High Court:<\/span> In a writ petition filed by Congress Spokesperson Aminul Khan Suri, under Article 226<\/a> of the Constitution of India<\/a> seeking a direction to respondent 3 (SHO of Tilak Nagar Police Station) to act upon a complaint made by Congress Spokesperson Aminul Khan Suri against BJP Minister Kailash Vijayvargiya, a single-judge bench comprising of Pranay Verma, J., disposed of the petition with a direction to the SHO, Police Station Tilak Nagar, to consider the petitioner’s complaint and take appropriate action within 90 days.<\/p>\n

The Court noted that the petitioner filed a writ petition seeking two reliefs: firstly, a direction to respondent no.3 (SHO of Tilak Nagar Police Station) to act upon a complaint dated 16-04-2022 filed by him against BJP Minister Kailash Vijayvargiya regarding alleged sharing of a false video on X (Twitter) to incite the communal riots which was erupted in Khargone during the Ram Navami in April 2022, in accordance with the law within a time-bound manner, and secondly, for the costs of the petition to be awarded to the petitioner and any other relief deemed fit by the Court.<\/p>\n

The Court referred to its previous decision in Rajendra Singh Pawar<\/span> v. State of M.P.<\/span>, 2020 SCC OnLine MP 4451<\/a>, where directions were issued regarding the processing of complaints by police officers within a stipulated time frame. The Court in Rajendra Singh Pawar<\/span> (Supra) held that complaints filed at police stations must be examined promptly, and if required, a preliminary inquiry should be conducted to ascertain whether the information discloses any cognizable offense. The Court emphasised the need for expeditious processing of complaints, especially in cases of economic offenses like cheating and fraud.<\/p>\n

Without expressing any opinion on the merits of the case, the Court disposed of the writ petition and directed the SHO, Police Station Tilak Nagar, District Indore, to consider the petitioner’s complaint and take appropriate action within 90 days from the date of receipt of the certified copy of the order. Additionally, the petitioner was instructed to provide proof of filing the complaint within 7 days to the SHO, Police Station Tilak Nagar, District Indore.<\/p>\n
