Kerala High Court:<\/span> The Single Judge Bench of Bechu Kurian Thomas, J. closed the plea filed by the father of deceased veterinary student for transferring the case to Central Bureau of Investigation (CBI) for investigation, after noting that Union Government had issued a notification for investigation under Section 5<\/a> of Delhi Special Police Establishment Act, 1946<\/a> and that the CBI had registered an FIR. The Court noted that the CBI on 05-04-2024 issued a notification announcing to take over the investigation and registered a First Information Report.<\/p>\n

A second-year student studying in College of Veterinary and Animal Sciences in Pookode, Wayanad was found hanging in the hostel, due to alleged torture and ragging.<\/p>\n

Initially, the reason for death was registered as unnatural cause, eventually as the investigation moved forward additional offences were included, like- abetment of suicide, criminal conspiracy and provisions under the Kerala Prohibition of Ragging Act, 1998.<\/p>\n

The Court noted that the matter had serious repercussions and that the State Government had immediately decided to handover investigation to the CBI and a notification to that effect was also issued, however, the files were not forwarded immediately to the Central Government and the investigation was delayed. Hence, the Court on 05-04-2024 had directed the Central Government for issuing appropriate order under Section 5<\/a> of the Delhi Special Police Establishment Act, 1946<\/a> and take immediate action.<\/p>\n
