{"id":319060,"date":"2024-04-01T14:30:23","date_gmt":"2024-04-01T09:00:23","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=319060"},"modified":"2024-04-05T16:48:03","modified_gmt":"2024-04-05T11:18:03","slug":"kerala-hc-credit-rating-updated-three-weeks-legal-news","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/04\/01\/kerala-hc-credit-rating-updated-three-weeks-legal-news\/","title":{"rendered":"[Unresolved credit score complaint] Read how Kerala HC came to rescue borrower\u2019s right to updated CIBIL Score on closure of loan account and no subsisting loan"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Kerala High Court:<\/span> In a writ petition praying to direct Trans Union Cibil Limited (&#8216;TUCL&#8217;) to restore the credit rating of the petitioner to the levels entitled, since he had paid off his loan amount,Devan Ramachandran, J. gave necessary directions for such restoration.<\/p>\n<p style=\"margin-bottom: 3%;\">Aggrieved by the fact that despite the petitioner paying off the loan that he had availed from Canara Bank, TUCL continued to show his credit rating as low.<\/p>\n<p style=\"margin-bottom: 3%;\">TUCL submitted that the question in hand was pending for instructions with the Canara Bank.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court directed the TUCL to immediately advert to all the reports made by Canara Bank on the online portal and to make a decision on the credit rating of the petitioner within a period of three weeks from the receipt of copy of this judgment.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court said that TUCL has the liberty to requisition from Canara Bank, and under such circumstances, the time frame of three weeks will stand extended by a period of one month.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court reaffirmed that TUCL shall ensure that the requisite credit rating is given to the petitioner and reflected on the online portal within the afore time frames.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court also said that it is not entering into the request of the petitioner to direct the Banking Ombudsman, but this option might be required to be taken up in case the abovesaid directions are not adhered by.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">K Venugopal Nair v.
