{"id":318789,"date":"2024-03-30T11:00:51","date_gmt":"2024-03-30T05:30:51","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=318789"},"modified":"2024-06-15T12:29:07","modified_gmt":"2024-06-15T06:59:07","slug":"wifes-consensual-sexual-relations-outside-marriage-constitutes-no-statutory-offence-raj-hc-scc-times","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/03\/30\/wifes-consensual-sexual-relations-outside-marriage-constitutes-no-statutory-offence-raj-hc-scc-times\/","title":{"rendered":"Consensual sexual relations outside marriage constitutes no statutory offence: Rajasthan High Court"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Rajasthan High Court:<\/span> In an application filed by applicant-husband seeking the recall of the order quashing the FIR under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561687\" target=\"_blank\" rel=\"noopener\">366<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> (IPC), a single-judge bench comprising of <span style=\"font-weight: bold;\">Birendra Kumar,* J.<\/span>, while dismissing the application held that no statutory offense under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561845\" target=\"_blank\" rel=\"noopener\">494<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561848\" target=\"_blank\" rel=\"noopener\">497<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a> was made out since the wife&#8217;s voluntary live-in relationship did not constitute adultery or remarriage during the lifetime of a spouse.<\/p>\n<p style=\"margin-bottom: 3%;\">In the instant matter, the respondent filed an application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">Criminal Procedure Code, 1973<\/a> (CrPC) seeking the recalling of an order passed by the High Court quashing an FIR under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561687\" target=\"_blank\" rel=\"noopener\">366<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>. Respondent claimed to be the informant of the FIR but couldn&#8217;t contest the case earlier due to incarceration in another matter. The FIR was filed alleging the abduction of his wife by the accused.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court considered the respondent&#8217;s contention alongside the statement of the wife, who appeared before the court and affirmed that she wasn&#8217;t abducted but was in a voluntary live-in relationship with one of the accused. The applicant argued that despite the wife&#8217;s admission to an extra-marital relationship, offences under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561845\" target=\"_blank\" rel=\"noopener\">494<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561848\" target=\"_blank\" rel=\"noopener\">497<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a> should apply to protect social morality cited in <span style=\"font-style: italic;\">Manjot Singh<\/span> v. <span style=\"font-style: italic;\">State of Punjab<\/span>, Criminal Writ Petition No.158\/2023, order dated 25-01-2023, but the Court noted that relevant Supreme Court precedent as weren&#8217;t presented in that case. Relying on precedents such as <span style=\"font-style: italic;\">Navtej Singh Johar<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/8gd9DlY2\" target=\"_blank\" rel=\"noopener\">(2018) 10 SCC 1<\/a> and <span style=\"font-style: italic;\">Safi Jahan<\/span> v. <span style=\"font-style: italic;\">Asokan K.M.<\/span>, (2018) 6 SCC 368, the Court emphasised on the primacy of constitutional morality over societal morality, particularly regarding privacy rights.<\/p>\n<p style=\"margin-bottom: 3%;\">Referring to <span style=\"font-style: italic;\">S. Khushboo<\/span> v. <span style=\"font-style: italic;\">Kanniammal<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/Pci7b72c\" target=\"_blank\" rel=\"noopener\">(2010) 5 SCC 600<\/a> and <span style=\"font-style: italic;\">Joseph Shine<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/381qNjbV\" target=\"_blank\" rel=\"noopener\">(2019) 3 SCC 39<\/a>, the Court reiterated that <span style=\"font-weight: bold;\">&#8220;no statutory offence takes place when adults willingly engage in sexual relations outside the marital setting&#8221;<\/span>, except for adultery, which had been struck down. Furthermore, the offense under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561845\" target=\"_blank\" rel=\"noopener\">494<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a> applies only if a remarriage during the lifetime of a spouse is proven, not merely a live-in relationship. The wife and other accused jointly affirmed the voluntary nature of the relationship with one of the accused. Consequently, the Court found no merit in the applicant&#8217;s plea and dismissed the petition.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\"><span
