X and Art. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574877\" target=\"_blank\" rel=\"noopener\">145(3)<\/a> &#8212; Power of Speaker\/Deputy Speaker to initiate disqualification proceedings, when proceedings for removal from the office initiated against them:<\/span> Important constitutional questions relating to interpretation of Sch. X regarding disqualification, as well as powers of Speaker and Governor and power of judicial review thereof are involved in this case, hence matter requires reference to a five-Judge Bench under Art. 145(3). [<i>Subhash Desai<\/i> v. <i>State of Maharashtra<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/fI889e91\" target=\"_blank\" rel=\"noopener\">(2024) 2 SCC 825<\/a>]<\/p>\n<\/div>\n<div style=\"border-bottom: 1px solid black; border-bottom-style: dashed;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution of India<\/a> &#8212; Sch. X and Arts. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574914\" target=\"_blank\" rel=\"noopener\">179(c)<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574928\" target=\"_blank\" rel=\"noopener\">191(2)<\/a> &#8212; Disqualification of Member under Sch. X:<\/span> In this case, the issue was permissibility of adjudication of disqualification of Member under Sch. X, by Speaker, when notice of intention to move a resolution for removal of Speaker himself has been issued. Ruling in Nabam Rebia, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/kZFHax47\" target=\"_blank\" rel=\"noopener\">(2016) 8 SCC 1<\/a> on this issue held, warranted re-consideration by larger Bench, hence, matter so referred to larger Bench. [<i>Subhash Desai<\/i> v. <i>State of Maharashtra<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/MuePXgoS\" target=\"_blank\" rel=\"noopener\">(2024) 2 SCC 719<\/a>]<\/p>\n<\/div>\n<div style=\"background-color: #e6eeff; border-bottom: 1px solid black; border-bottom-style: dashed;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution of India<\/a> &#8212; Sch. X and Arts. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574914\" target=\"_blank\" rel=\"noopener\">179(c)<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574928\" target=\"_blank\" rel=\"noopener\">191(2)<\/a>:<\/span> In this case, the issue was permissibility of adjudication on disqualification of a member by Speaker, when notice of intention to move a resolution for removal of Speaker himself has been issued and ruling in Nabam Rebia, (2016) 8 SCC 1, on this issue, whether to be referred to larger Bench, determined. [<i>Subhash Desai<\/i> v. <i>State of Maharashtra<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/NWm7pZX6\" target=\"_blank\" rel=\"noopener\">(2024) 2 SCC 822<\/a>]<\/p>\n<\/div>\n<div style=\"border-bottom: 1px solid black; border-bottom-style: dashed;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">Criminal Procedure Code, 1973<\/a> &#8212; S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519660\" target=\"_blank\" rel=\"noopener\">374<\/a> &#8212; Appeal against conviction &#8212; Interference by appellate court in &#8212; When warranted:<\/span> Appellate court should be slow in interfering with conviction recorded by courts below. But where evidence on record indicates that prosecution has failed to prove guilt of accused beyond reasonable doubt and that a plausible view, different from one expressed by courts below can be taken, appellate court should not shy away in giving benefit of doubt to accused persons.
