The provisions came into force on 16-3-2024.<\/p>\n<p style=\"\">A new Chapter XIVA relating to <span style=\"font-weight: bold;\">&#8220;Adjudication of Penalties and Appeals&#8221;<\/span> has been inserted under which any person can file a complaint to the <span style=\"font-weight: bold;\">adjudicating officer<\/span> (&#8216;AO&#8217;) through electronic means regarding any <span style=\"font-weight: bold;\">contravention committed under<\/span> the following Section of the <span style=\"font-weight: bold;\"><a href=\"http:\/\/www.scconline.com\/DocumentLink\/r4qFF5wg\" target=\"_blank\" rel=\"noopener\">Patents Act, 1970<\/a>:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Section 120<\/span>&#8211; Unauthorized claim of patent rights<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Section 122<\/span>&#8211; Refusal or failure to supply information<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Section 123<\/span>&#8211; Practice by non-registered patent agents<\/p>\n<\/li>\n<\/ul>\n<p style=\"font-weight: bold;\">Key Points:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p style=\"font-weight: bold;\">Holding of inquiry-<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>AO will issue a show cause notice through electronic means within the time specified in the notice which cannot be less than 7 days from the date of service.<\/p>\n<\/li>\n<li>\n<p>Alleged nature of contravention should be mentioned in the notice.<\/p>\n<\/li>\n<li>\n<p>In case, a notice requiring the appearance is issued, on the date fixed, the AO will have to explain to the person the alleged contravention.<\/p>\n<\/li>\n<li>\n<p>AO will not be bound to observe only the provisions of Bhartiya Sakshya Adhiniyam 2023.<\/p>\n<\/li>\n<li>\n<p>In case AO is satisfied that the person has committed contravention, he can order, in writing, to impose penalty.<\/p>\n<\/li>\n<li>\n<p>Every order should specify the Act in respect of which contravention has been committed and the reasons for imposing penalty.<\/p>\n<\/li>\n<li>\n<p>AO will have to complete the proceeding within 3 months from issuance of the notice to the opposite party.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Any person aggrieved from the order can file an <span style=\"font-weight: bold;\">appeal<\/span> with the appellate authority within 60 days from the date of order, through electronic means.<\/p>\n<p>The appellate authority will have to pass a reasoned order, including order of adjournment and complete the proceedings within 6 months from the date of receipt of appeal.<\/p>\n<\/li>\n<li>\n<p>All communication under this chapter has to be done electronically only.<\/p>\n<\/li>\n<li>\n<p>Every order made under this Chapter should be:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Dated;<\/p>\n<\/li>\n<li>\n<p>Digitally signed;<\/p>\n<\/li>\n<li>\n<p>Communicated to all parties;<\/p>\n<\/li>\n<li>\n<p>Uploaded on official website of AO\/ appellate authority.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p> Following Forms have been inserted:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Form 31-<\/span> Complaint for Contravention or default of Sections 120, 122 and 123<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Form 32-<\/span> Appeal against an order passed by the Adjudicating
