{"id":317459,"date":"2024-03-17T12:00:06","date_gmt":"2024-03-17T06:30:06","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=317459"},"modified":"2024-03-17T11:26:12","modified_gmt":"2024-03-17T05:56:12","slug":"moef-notifies-plastic-waste-management-amendment-rules-2024-legal-news","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/03\/17\/moef-notifies-plastic-waste-management-amendment-rules-2024-legal-news\/","title":{"rendered":"MOEF revises provisions relating to plastic packaging and commodities made from compostable plastics or biodegradable plastics"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 14-3-2024, the Ministry of Environment, Forest and Climate Change notified the <span style=\"font-weight: bold;\">Plastic Waste Management (Amendment) Rules, 2024<\/span> to amend the <a href=\"http:\/\/www.scconline.com\/DocumentLink\/TF0bvIcw\" target=\"_blank\" rel=\"noopener\">Plastic Waste Management Rules, 2016<\/a>. The provisions came into force on 14-3-2024.<\/p>\n<p style=\"font-weight: bold;\">Key Points:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>The definition of <span style=\"font-weight: bold;\">&#8220;importer&#8221;<\/span> has been made specific and now includes the imports of any plastic packaging\/ commodity with plastic packaging\/ carry bags\/ plastic sheets\/ plastic raw material, including in the form of resin\/ pellets\/ intermediate material used for manufacturing plastic packaging\/ films\/ preforms, for commercial use.<\/p>\n<p><span style=\"font-weight: bold;\">Earlier<\/span>, &#8220;importer&#8221; meant a person who imports plastic packaging or products with plastic packaging or carry bags or multilayered packaging or plastic sheets or like.<\/p>\n<\/li>\n<li>\n<p>Earlier, &#8220;<span style=\"font-weight: bold;\">Manufacturer&#8221;<\/span> meant and included a person\/ unit\/ agency engaged in production of plastic raw material to be used as raw material by the producer.<\/p>\n<p>Now, it includes a person engaged in production of plastic raw material\/ compostable plastics\/ biodegradable plastics.<\/p>\n<\/li>\n<li>\n<p>Earlier, the ambit of the definition of <span style=\"font-weight: bold;\">&#8220;Producer&#8221;<\/span> was limited to people engaged in manufacturing of plastic packaging.<\/p>\n<p>Now, it also includes persons engaged in:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Manufacturing of intermediate material that is used for manufacturing plastic packaging;<\/p>\n<\/li>\n<li>\n<p>Contract manufacturing of products using plastic packaging or through other similar arrangements for a brand owner.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>Definition of &#8220;<span style=\"font-weight: bold;\">seller&#8221;<\/span> has been inserted which means any person who sells plastic raw material for producing plastic packaging is a seller.<\/p>\n<\/li>\n<li>\n<p>Rule 4 relates to <span style=\"font-weight: bold;\">&#8220;Conditions&#8221;<\/span> and the provision relating to selling of raw material has been revised.<\/p>\n<p>Earlier, only the producer who had a valid registration from the State Pollution Control Boards or Pollution Control Committee could get raw material from the manufacturer.<\/p>\n<p>Now, only the producers registered under these rules can get raw materials from the manufacturer.<\/p>\n<\/li>\n<li>\n<p>The manufacturers of compostable plastic\/ biodegradable plastic carry bags or commodities permitted under the rules, will have to obtain a certificate from the Central Pollution Control Board <span style=\"font-weight: bold;\">(&#8216;CPCB&#8217;)<\/span> before marketing or selling.<\/p>\n<\/li>\n<li>\n<p>The manufacturer of compostable plastic\/ biodegradable plastic will have to inform the CPCB, the quantity of such commodities introduced in the market and the pre-consumer waste generated by it.<\/p>\n<\/li>\n<li>\n<p>Some provisions have been inserted which enables the <span style=\"font-weight: bold;\">local body to assess<\/span>:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>The plastic waste generated;<\/p>\n<\/li>\n<li>\n<p>Plastic waste management infrastructure available for collection\/ segregation\/ processing and send a report to the State Pollution Control Board or Pollution Control Committee by 30th June of each year;<\/p>\n<\/li>\n<li>\n<p>measures to prevent stocking, distribution, sale and usage of prohibited single use plastic items in their jurisdiction.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The Annual report will include:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>plastic waste management infrastructure available for collection, segregation, processing;<\/p>\n<\/li>\n<li>\n<p>projection of plastic waste to be generated;<\/p>\n<\/li>\n<li>\n<p>status on framing and implementation on byelaws;<\/p>\n<\/li>\n<li>\n<p>Action taken to prevent stocking, distribution, sale and usage of prohibited Single Use Plastic items.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Rule 7-A<\/span> relating to <span style=\"font-weight: bold;\">&#8220;Responsibility of Panchayat at District level&#8221;<\/span> has been inserted which lays down similar responsibilities the l<span style=\"font-weight: bold;\">ocal body has to assess<\/span>.<\/p>\n<\/li>\n<li>\n<p>Another provision in the <span style=\"font-weight: bold;\">Protocols for compostable and biodegradable plastic materials<\/span> has been inserted which says that the BIS should specify separate colour\/ marking for plastic packaging and commodities made from compostable plastics\/ biodegradable plastics.<\/p>\n<\/li>\n<li>\n<p>New provisions have been inserted in<span style=\"font-weight: bold;\"> Rule 11<\/span> relating to <span style=\"font-weight: bold;\">&#8220;Marking or labelling&#8221;:<\/span><\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>The commodity made from compostable plastic will have to bear a label &#8220;<span style=\"font-weight: bold;\">compostable only under industrial composting<\/span>&#8221; and shall conform to the Indian Standard: IS\/ISO 17088:2021 titled as Specifications for Compostable Plastics.<\/p>\n<\/li>\n<li>\n<p>The commodity made from biodegradable plastic will have to bear the label &mdash;<span style=\"font-weight: bold;\">Biodegradable in [ &#8212; specify number of days &#8212;] only in the [&#8212;specify recipient environment such as soil, landfill, water etc.&#8212;]<\/span><\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>The following forms have been revised&#8221;<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p><span style=\"font-weight: bold;\">Form I-<\/span> Application for registration for producers or Brand Owners has been substituted.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Form V-<\/span> Format for Annual Report on Plastic Waste Management to be submitted by the Urban Local Body<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Form VI-<\/span> Format for Annual Report on Plastic Waste Management to be submitted by SPCB\/ PCC<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Form VII-<\/span> Format for Quarterly report of Plastic Raw Material<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p style=\"font-style: italic;\">Definitions of &#8220;importer&#8221;, &#8220;manufacturer&#8221;
