We’re thrilled to announce the 15th NLU Antitrust Law Moot Court Competition, happening from 15-17 March at the esteemed National Law University, Jodhpur. With meticulous planning and great enthusiasm, NLU Jodhpur proudly presents this exciting initiative.\u00a0<\/span><\/p>\n

The competition in partnership with CCI (Competition Commission of India) and Cyril Amarchand Mangaldas,\u00a0 knowledge partners SCC Online and Eastern Book Company, aims to enrich education by offering intellectually stimulating opportunities. We seek to cultivate knowledge and research in competition law<\/span> through this platform, allowing participants to refine their moot court skills and delve into complex competition law issues.<\/span><\/p>\n

Day 1<\/strong><\/p>\n

10:00 AM<\/strong> \u2013<\/b> Inauguration Ceremony:<\/span><\/span><\/p>\n

The Inaugural Ceremony of the 15th NLU Antitrust Law Moot Court Competition commenced with a grand inauguration, graced by esteemed dignitaries including Mr Augustine Peter former member of CCI, th<\/span>e Vice-Chancellor, Prof. (Dr.) Harpreet Kaur, and Prof. (Dr.) I.P. Massey, Dean, Faculty of Law. Ms. Akshita Saxena, the convenor of the Moot Court Committee, delivered the welcome address, followed by an inaugural speech from Prof. (Dr.) Harpreet Kaur, and a welcome address by Mr Augustine Peter who expressed his appreciation for the substantial turnout of participants and talked about his journey in the CCI. Prof. (Dr.) I.P. Massey also shared insights with the attendees, and the inaugural ceremony concluded with an address from the Moot Court Committee Chairperson, Mr. Siddharth Balani. Finally, the Chief Guest was presented with a memento of appreciation.<\/span><\/p>\n

The judges overseeing the Preliminary Rounds received a comprehensive briefing on the Moot problem. They were furnished with a detailed bench memorial as well as a summarized version of the memorials. These judges, eminent legal figures in their respective domains, are present to scrutinize and appraise each team’s comprehension and expertise in the realm of law. The preliminary rounds will commence promptly after this briefing.<\/span><\/p>\n

11:00 AM<\/strong> – Commencement of Preliminary rounds:<\/span><\/span><\/p>\n

The Preliminary Rounds have commenced with immense enthusiasm in all courtrooms, and the teams are fully prepared to present their meticulously crafted arguments. The judges actively assess the counsels’ arguments, with questions flowing in steadily. The teams are well-prepared, addressing inquiries by citing relevant laws. Following an intense mooting session, the teams will also submit their rebuttals and sur-rebuttals.<\/span><\/p>\n

1:30 PM<\/strong>– Conclusion of Preliminary Rounds and Lunch:<\/span><\/p>\n

The Preliminary Rounds concluded with great success, prompting both judges and participants to take a well-deserved break. The competition is now transitioning into the Reverse Preliminary rounds, commencing at 3:00 PM. The outcomes of both rounds will collectively determine the teams advancing to the Quarter-Final rounds, generating an atmosphere of anticipation and excitement in the courtrooms!<\/p>\n

3:00<\/strong> PM<\/strong> – Reverse Preliminary Rounds:<\/span><\/p>\n

With renewed vigour and enthusiasm, all teams are now poised to present their arguments. In the Reverse Preliminary Rounds, each team will tackle the task of advocating for the opposing side, ensuring equity and parity for all. As the rounds are underway, participants exhibit their impressive argumentative prowess and showcase their mooting expertise.<\/p>\n

The highly anticipated moment has arrived! The commencement of the Final Rounds for the 15th NLU Antitrust Law Moot Court Competition is upon us. Our finalists, Rajiv Gandhi National Law University Punjab<\/em><\/strong> and NMIMS, Mumbai<\/em>,<\/strong> are poised to engage in a fierce battle of legal prowess. Heading the distinguished bench for the Final Rounds are… Mr Kirthi Srinivas, Mr Vijay Pratap Singh Chauhan<\/em><\/strong> and Mr Dhruv Rajain<\/em><\/strong> are Partners at Cyril Amarchand Mangaldas. Mr K. D. Singh<\/em><\/strong> is Director, Competition Division at the Competition Commission of India and Mr Samar Bansal<\/strong><\/em> is an Advocate at the Supreme Court.<\/p>\n

10:30 AM<\/strong> – Final Rounds<\/span>
\nThe much anticipated final rounds are underway between Rajiv Gandhi National University of Law, Patiala<\/strong> <\/em>and NMIMS, Mumbai<\/strong><\/em>. Tensions are high and both teams are bringing their A-Game to the podium today.<\/p>\n

\nThe first arguments for the day were presented by the appellants, represented by Rajiv Gandhi National University of Law, Patiala.<\/strong><\/em> The first speaker took up the first and second issues at hand which dealt with the market power of the appellants and the question of anti-competitive clauses in contracts that precluded signees from taking on other projects. The speaker relied on relevant legal principles and several precedents to substantiate their case. The learned bench raised many pertinent questions, focusing on the aspects of monopoly and the question of whether there was an implicit anti-competitive colour to the clauses in question. The dias was then taken by the second speaker from RGNUL who focused on the third and fourth issues concerning the locus standi of the appellant in challenging the decision of the CCI in the concerned tribunal.<\/p>\n

The stage then passed to NMIMS, Mumbai<\/strong><\/em> who argued on behalf of the respondents. The first speaker dealt with the first and second issues, using a slew of relevant case laws and sections of the Competition Act, of 2002. The speaker argued that the actions of the appellant created anti-competitive situations in the market. The honourable bench raised several pertinent questions, the prime of which was whether the increasing prevalence of OTT apps was a breach of competition law conventions due to the detriment they posed to brick-and-mortar theatres. The dias then moved to the second speaker who dealt with the third and fourth issues which dealt with the right of appeal against the decision of the CCI. Relevant case laws were once again brought up to substantiate their position and the learned bench raised important and relevant questions to examine the participants\u2019 subject matter knowledge.<\/p>\n
