{"id":316086,"date":"2024-03-04T18:00:34","date_gmt":"2024-03-04T12:30:34","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=316086"},"modified":"2024-03-14T16:52:02","modified_gmt":"2024-03-14T11:22:02","slug":"thc-upholds-validity-of-s-382-rpa-legal-news-scc-times","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/03\/04\/thc-upholds-validity-of-s-382-rpa-legal-news-scc-times\/","title":{"rendered":"Telangana HC upholds validity of S.38(2) of RPA which provides for preferential treatment to candidates of political party over other independent candidates"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Telangana High Court:<\/span> In a case wherein petitioner assailed the validity of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558779\" target=\"_blank\" rel=\"noopener\">38(2)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801315\" target=\"_blank\" rel=\"noopener\">Representation of the People Act, 1951<\/a> (&#8216;RPA&#8217;), and Rule 5.7.1 of the Handbook for Candidate (&#8216;Handbook&#8217;) issued by the Election Commission of India, the Division Bench of <span style=\"font-weight: bold;\">Alok Aradhe, C.J.<\/span>, and N.V. Shravan Kumar, J., dismissed the petition and held that the contention that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558779\" target=\"_blank\" rel=\"noopener\">38(2)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801315\" target=\"_blank\" rel=\"noopener\">RPA<\/a> treated the equals as unequals could not be accepted and neither Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558779\" target=\"_blank\" rel=\"noopener\">38(2)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801315\" target=\"_blank\" rel=\"noopener\">RPA<\/a> nor Rule 5.7.1 of the Handbook could be said to be violative of Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574870\" target=\"_blank\" rel=\"noopener\">14<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution<\/a>.<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">Petitioner was an Advocate and had taken part in the general elections to the State Legislative Assembly. He had previously filed public interest litigation, challenging the validity of the very same provisions, which was dismissed on 12-02-2024 with the liberty to petitioner to take recourse to the remedy available to him under the law. The petitioner thereafter filed the present writ petition.<\/p>\n<p style=\"margin-bottom: 3%;\">Petitioner submitted that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558779\" target=\"_blank\" rel=\"noopener\">38(2)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801315\" target=\"_blank\" rel=\"noopener\">RPA<\/a>, which provided for a preferential treatment to be given to the candidates of a political party over the other independent candidates and other candidates belonging to registered unrecognized political parties in the matter of publication of list of contesting candidates, was arbitrary and violative of Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574870\" target=\"_blank\" rel=\"noopener\">14<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution<\/a>, as all the candidates contesting the election were equal. It was also submitted that Rule 5.7.1 of the Handbook, based on Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558779\" target=\"_blank\" rel=\"noopener\">38(2)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801315\" target=\"_blank\" rel=\"noopener\">RPA<\/a>, also suffered from the vice of arbitrariness.<\/p>\n<p style=\"font-weight: bold;\">Analysis, Law, and Decision<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558779\" target=\"_blank\" rel=\"noopener\">38<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801315\" target=\"_blank\" rel=\"noopener\">RPA<\/a> dealt with publication of list of contesting candidates and Rule 5.7 of the Handbook dealt with arrangement of names in the list of contesting candidates. The Court opined that Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574870\" target=\"_blank\" rel=\"noopener\">14<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution<\/a> was attracted when equals were sought to be treated unequally or unequals were sought to be treated equally. Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558779\" target=\"_blank\" rel=\"noopener\">38(2)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801315\" target=\"_blank\" rel=\"noopener\">RPA<\/a>, for the purpose of publication of list of contesting candidates, classified the candidates in three categories, (a) candidates belonging to the recognized political parties; (b) candidates belonging to the registered political parties other than those mentioned in clause (a); and (c) other candidates. Thus, Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558779\" target=\"_blank\" rel=\"noopener\">38(2)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801315\" target=\"_blank\" rel=\"noopener\">RPA<\/a>, for the limited purpose of publication of list of contesting candidates, did not treat the equals as unequals, as the candidates belonging to recognized political parties, registered political parties and independent political parties stand on a different footing.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court opined that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558796\" target=\"_blank\" rel=\"noopener\">52<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801315\" target=\"_blank\" rel=\"noopener\">RPA<\/a> was amended by the Representation of the People (Amendment) Ordinance, 1992, which provided for countermanding elections on death of a candidate belonging to a political party only. The Court relied on <span style=\"font-style: italic;\">Rama Kant Pandey v. Union of India<\/span>, <a href=\"https:\/\/www.scconline.com\/Members\/SearchResult.aspx\" target=\"_blank\" rel=\"noopener\"><span class=\"Hyperlink\" style=\"color: #0563c1;\">(1993) 2 SCC 438<\/span><\/a>, wherein the validity of the aforesaid Ordinance was challenged before the Supreme Court, and it was held that the right to contest the election as a candidate was neither a fundamental right nor a civil right.<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, the Court dismissed the petition and held that the contention that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558779\" target=\"_blank\" rel=\"noopener\">38(2)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801315\" target=\"_blank\" rel=\"noopener\">RPA<\/a> treated the equals as unequals could not be accepted and neither Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558779\" target=\"_blank\" rel=\"noopener\">38(2)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801315\" target=\"_blank\" rel=\"noopener\">RPA<\/a> nor Rule 5.7.1 of the Handbook could be said to be violative of Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574870\" target=\"_blank\" rel=\"noopener\">14<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Pareekshith Reddy Pesarikayala v.
