{"id":315013,"date":"2024-02-22T15:00:49","date_gmt":"2024-02-22T09:30:49","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=315013"},"modified":"2024-02-28T16:30:40","modified_gmt":"2024-02-28T11:00:40","slug":"limitation-appeal-against-acquittal-can-be-condoned-supreme-court","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/02\/22\/limitation-appeal-against-acquittal-can-be-condoned-supreme-court\/","title":{"rendered":"Limitation for appeal against acquittal can be condoned: Supreme Court"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Supreme Court:<\/span> In an appeal challenging Delhi High Court&#8217;s dismissal of application challenging condonation of delay for an appeal against acquittal, the Division Bench of <span style=\"font-weight: bold;\">Sudhanshu Dhulia*<\/span> and Prasanna Bhalachandra Varale, JJ. clarified that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519664\" target=\"_blank\" rel=\"noopener\">378<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">Criminal Procedure Code, 1973<\/a> (&#8216;CrPC&#8217;) does not exclude applicability of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001553197\" target=\"_blank\" rel=\"noopener\">5<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726959\" target=\"_blank\" rel=\"noopener\">Limitation Act, 1963<\/a>.<\/p>\n<p style=\"font-weight: bold;\">Brief Facts<\/p>\n<p style=\"margin-bottom: 3%;\">The appellant was one of the four accused in a case under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001565503\" target=\"_blank\" rel=\"noopener\">135(1)(b)<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002780399\" target=\"_blank\" rel=\"noopener\">Customs Act, 1962<\/a>, who faced trial and was acquitted by the Trial Court. The said acquittal was appealed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519664\" target=\"_blank\" rel=\"noopener\">378<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> before the High Court with a delay of 72 days, and condonation was allowed by the Delhi High Court on 18-05-2016. The appellant moved an application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> seeking to recall order challenging condonation of delay while claiming that Section 5 of Limitation Act would not apply for an appeal against acquittal. The two applications were dismissed by the High Court on 20-01-2017 without assigning any reasons. The said order for dismissal was challenged in the instant matter claiming that the High Court committed a patent error while allowing the belated appeal against acquittal filed by public servant while it had no powers to condone delay, stating that Section 378 is a self-contained Code for limitation purposes in the absence of any prescribed period for filing appeal against acquittal in the Limitation Act.<\/p>\n<p style=\"font-weight: bold;\">Court&#8217;s Analysis<\/p>\n<p style=\"margin-bottom: 3%;\">The Court referred to <span style=\"font-style: italic;\">Kaushalya Rani<\/span> v. <span style=\"font-style: italic;\">Gopal Singh<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/Zerb2rL3\" target=\"_blank\" rel=\"noopener\">1963 SCC OnLine SC 41<\/a> wherein it was held that &#8216;Section 5 of the Limitation Act would not apply in an application for leave to appeal under sub-section 3 of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519709\" target=\"_blank\" rel=\"noopener\">417<\/a> of the old <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> before High Court, in as much as Section 417 is a special code in itself and the limitation prescribed therein is 60 days and the court has no power to relax such a limitation to condone the delay.&#8217;<\/p>\n<p style=\"margin-bottom: 3%;\">The Court perused Section 29(2) of the old Limitation Act to hint that Section 5 of the old Act was expressly excluded in cases where special law or local law provides for a period of limitation. Comparing the old and new Limitation Act, the Court highlighted that in both, the provision of extension of time of limitation is given in Section 5. <span style=\"font-style: italic;\">&#8220;Whereas 1908 Act specifically states that Section 5 will not apply when the period of limitation is given in special Acts, the 1963 Act makes Section 5 applicable even in the special laws when a period of limitation is prescribed, unless it is expressly excluded by such special law.&#8221;<\/span> The Court explained the same through a comparative table of Section 29(2) for both old and new provision.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court acknowledged that in case of special law prescribing a limitation period, Section 5 of the Limitation Act would have no application and highlighted the importance of language used in the special statute. The Court referred to Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558839\" target=\"_blank\" rel=\"noopener\">81<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001558844\" target=\"_blank\" rel=\"noopener\">86(1)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002801315\" target=\"_blank\" rel=\"noopener\">Representation of Peoples Act, 1951<\/a>, hinting towards the express bar on filing an election petition beyond 45 days, leaving no choice for the Court but to dismiss the election petition filed beyond 45 days&#8217; period.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court referred to catena of cases like <span style=\"font-style: italic;\">Hukumdev Narain Yadav<\/span> v. <span style=\"font-style: italic;\">Lalit Narain Mishra<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/G0vd1IHG\" target=\"_blank\" rel=\"noopener\">(1974) 2 SCC 133<\/a> and <span style=\"font-style: italic;\">Gopal Sardar<\/span> v. <span style=\"font-style: italic;\">Karuna Sardar<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/A5qTn1Jc\" target=\"_blank\" rel=\"noopener\">(2004) 4 SCC 252<\/a>, and clarified that neither of the two would be applicable to the instant matter since both deal with special laws prescribing limitation period with clear expression of language regarding condonation of delay.<\/p>\n<p style=\"margin-bottom: 3%;\">Coming back to the instant matter, the Court clarified that there was no exclusionary provision under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519664\" target=\"_blank\" rel=\"noopener\">378<\/a> <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>, and that the benefit under Section 5 read with Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001553181\" target=\"_blank\" rel=\"noopener\">2<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001553192\" target=\"_blank\" rel=\"noopener\">3<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726959\" target=\"_blank\" rel=\"noopener\">Limitation Act, 1963<\/a> could be availed in an appeal against acquittal.
