The alleged forged documents included a certificate of enlistment from the Madhyamgram Municipality and a leave and licence agreement.<\/p>\n<p style=\"font-weight: bold;\">Moot Point<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p>Whether the allegations made in the applications under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519620\" target=\"_blank\" rel=\"noopener\">340<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> fall within the purview of the said provision?<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">Whether the ingredients of forgery and fraudulent use of documents, as outlined in Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561805\" target=\"_blank\" rel=\"noopener\">463<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561814\" target=\"_blank\" rel=\"noopener\">471<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> (IPC), are established in this case?<\/p>\n<\/li>\n<\/ol>\n<p style=\"font-weight: bold;\">Court&#8217;s Assessment<\/p>\n<p style=\"margin-bottom: 3%;\">The Court examined the allegations in light of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519439\" target=\"_blank\" rel=\"noopener\">195(1)(b)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>, which references Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561805\" target=\"_blank\" rel=\"noopener\">463<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561814\" target=\"_blank\" rel=\"noopener\">471<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a> and noted that while Section 195(1)(b)(i) pertains to certain sections of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>, the primary offenses in this case fall under Section 195(1)(b)(ii), particularly forgery as defined in Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561805\" target=\"_blank\" rel=\"noopener\">463<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a> and its consequential offense under Section 471. Thus, the Court focused on assessing whether the offenses enumerated in Section 195(1)(b)(ii) were prima facie established.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court analysed the elements of forgery under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561805\" target=\"_blank\" rel=\"noopener\">463<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>, which includes making false statements with intent to cause damage or injury, or to support any claim or title. The Court also considered the fraudulent or dishonest use of forged documents under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561814\" target=\"_blank\" rel=\"noopener\">471<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">IPC<\/a>. However, the Court found that the alleged acts of defacing\/interpolation in the documents were not material to the outcome of the writ petition, as even without them, the writ petitioner could have established their claim.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court emphasised the absence of mens rea, or criminal intent, on the part of the writ petitioner and concluded that since the commission of the alleged forgery would not have impacted the outcome of the matter regarding the petitioner&#8217;s possession, there was no reason to deduce deliberate intention to mislead the court.<\/p>\n<p style=\"margin-bottom: 3%;\">Additionally, the Court considered the broader concept of &#8220;interests of justice&#8221; as required by Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519620\" target=\"_blank\" rel=\"noopener\">340<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>, which stands on a higher footing than individual causes of action. The Court found that the alleged actions of the writ petitioner did not warrant further inquiry in the interests of justice, as they did not constitute a higher category of offenses requiring such action.
