{"id":313475,"date":"2024-02-09T09:00:55","date_gmt":"2024-02-09T03:30:55","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=313475"},"modified":"2024-02-16T17:07:02","modified_gmt":"2024-02-16T11:37:02","slug":"cal-hc-sets-aside-issuance-of-process-remands-matter-for-compliance-with-section-202-of-crpc-scc-blog","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/02\/09\/cal-hc-sets-aside-issuance-of-process-remands-matter-for-compliance-with-section-202-of-crpc-scc-blog\/","title":{"rendered":"Calcutta High Court sets aside Issuance of Process; remands matter to Magistrate for compliance with Section 202 of CrPC"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Calcutta High Court:<\/span> While deciding whether the process issued against the petitioner by the Magistrate was valid considering the petitioner&#8217;s residence outside the territorial jurisdiction of the Magistrate, a single-judge bench comprising of <span style=\"font-weight: bold;\">Subhendu Samanta,* J.<\/span>, held that the Magistrate had issued process against the petitioner without complying with the provisions of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519452\" target=\"_blank\" rel=\"noopener\">202<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">Criminal Procedure Code, 1973<\/a> (CrPC), which mandates the postponement of the issuance of process if the accused resides beyond the territorial jurisdiction of the Magistrate. The Court remanded the matter to the Magistrate for fresh orders in compliance with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519452\" target=\"_blank\" rel=\"noopener\">202<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">In the instant matter, the petitioner filed an application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\" target=\"_blank\" rel=\"noopener\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> seeking to quash proceedings in complaint case pending before the Judicial Magistrate in relation to the complaint for the offences under Sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561758\" target=\"_blank\" rel=\"noopener\">420<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561375\" target=\"_blank\" rel=\"noopener\">120-B<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> (IPC) filed complainant-opposite party 2 against the petitioner. Upon receiving the complaint, the Magistrate examined the complainant and issued process against the petitioner under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519454\" target=\"_blank\" rel=\"noopener\">204<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519452\" target=\"_blank\" rel=\"noopener\">202<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>, if the accused person resides outside the territorial jurisdiction of the Magistrate, the issuance of process may be postponed, and an inquiry or investigation should be conducted to determine if there are sufficient grounds for proceeding. The Court referred to <span style=\"font-style: italic;\">Narmada Prasad Sankar<\/span> v. <span style=\"font-style: italic;\">Sardar Abtar Singh Chabra<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/jTyfD5U6\" target=\"_blank\" rel=\"noopener\">(2006) 9 SCC 601<\/a> and <span style=\"font-style: italic;\">National Bank of Oman<\/span> v. <span style=\"font-style: italic;\">Barakara Abdul Aziz<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/tV8I6LeG\" target=\"_blank\" rel=\"noopener\">(2013) 2 SCC 488<\/a>, which emphasised the importance of complying with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519452\" target=\"_blank\" rel=\"noopener\">202<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>. The Court noted that the Magistrate had failed to comply with the provisions of Section 202, as no inquiry or investigation was conducted despite the petitioner residing outside the jurisdiction.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court set aside the order for the issuance of process against the petitioner and remanded the matter to the Magistrate. The Magistrate was directed to pass fresh orders in accordance with Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519452\" target=\"_blank\" rel=\"noopener\">202<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> within two months from the date of the order. The Court clarified that the decision did not address the merits of the allegations against the petitioner and left all points open to be decided in subsequent proceedings.
