{"id":311518,"date":"2024-01-16T12:00:39","date_gmt":"2024-01-16T06:30:39","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=311518"},"modified":"2024-01-25T09:37:54","modified_gmt":"2024-01-25T04:07:54","slug":"chhattisgarh-hc-appeal-against-order-of-acquittal-u-s-138-of-ni-act-lies-to-high-court-u-s-3784-of-crpc-legal-news","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/01\/16\/chhattisgarh-hc-appeal-against-order-of-acquittal-u-s-138-of-ni-act-lies-to-high-court-u-s-3784-of-crpc-legal-news\/","title":{"rendered":"Appeal against order of acquittal u\/s 138 of Negotiable Instruments Act, 1881 lies to High Court u\/s 378(4) of CrPC: Chhattisgarh High Court"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Chhattisgarh High Court:<\/span> In a revision petition filed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519685\">397<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519692\">401<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\">Criminal Procedure Code, 1973<\/a> (&#8216;CrPC&#8217;), <span style=\"font-weight: bold;\">Deepak Kumar Tiwari,J.<\/span>, opined that the appeal against the order of acquittal in prosecution for the offence punishable under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544366\">138<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726957\">Negotiable Instrument Act, 1881<\/a> (&#8216;the NI Act&#8217;) would lie to the High Court under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519664\">378(4)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\">CrPC<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">In an instant case, the judgment of acquittal dated 13-01-2023, was passed by the 8<span style=\"vertical-align: super;\">th<\/span> Additional Sessions Judge, District Durg (&#8216;the Appellate Court&#8217;), whereby the Appellate Court had dismissed the appeal filed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519658\">372<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\">CrPC<\/a>, and observed that in a complaint case filed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544366\">138<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726957\">NI Act<\/a>, a complainant could file an application for special leave to appeal against an order of acquittal of any kind, only to the High Court by invoking the powers under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519664\">378(4)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\">CrPC<\/a>. Thus, the applicant filed the present revision petition.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court relied on <span style=\"font-style: italic;\">Mallikarjun Kodagali<\/span> v. <span style=\"font-style: italic;\">State of Karnataka<\/span> (&#8216;Mallikarjun Kodagali case&#8217;) <a href=\"https:\/\/www.scconline.com\/Members\/NoteView.aspx?enc=SlRYVC05MDAwMDUwMDc3JiYmJiY0MCYmJiYmU2VhcmNoJiYmJiZmdWxsc2NyZWVuJiYmJiZ0cnVlJiYmJiYyMDE4IFNDQyBPbkxpbmUgU0MgMTk0MSYmJiYmUGhyYXNlJiYmJiZnU2VhcmNoJiYmJiZmYWxzZQ==\">(2019) 2 SCC 752<\/a> and opined that the term &#8216;complaint&#8217; was defined in Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519448\">2(d)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\">CrPC<\/a> and any allegation made orally or in writing to a Magistrate that some person, had committed an offence, would fall within the meaning of &#8216;complaint&#8217;. However, the definition specifically excluded a police report. The Court further opined that once special leave to appeal was granted by the High Court, Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519664\">378(4)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\">CrPC<\/a> provided the complainant with the right to file appeal against acquittal in a case instituted upon a complaint.<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, the Court affirmed the decision of the Appellate Court and opined that the appeal against the order of acquittal in prosecution for the offence punishable under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544366\">138<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726957\">NI Act<\/a>, would lie to the High Court under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519664\">378(4)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\">CrPC<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Tarkeshwar Sahu v.
