{"id":311166,"date":"2024-01-10T18:30:55","date_gmt":"2024-01-10T13:00:55","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=311166"},"modified":"2024-01-10T18:23:32","modified_gmt":"2024-01-10T12:53:32","slug":"delhi-government-published-amendment-in-delhi-victims-compensation-scheme-legal-news","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2024\/01\/10\/delhi-government-published-amendment-in-delhi-victims-compensation-scheme-legal-news\/","title":{"rendered":"Delhi Govt widens the ambit of \u201cVictim\u201d by including mob violence &amp; mob lynching injury cases"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 5-1-2024, the Government of the National Capital Territory of Delhi published an amendment of <a href=\"http:\/\/www.scconline.com\/DocumentLink\/7873O0jO\" target=\"_blank\" rel=\"noopener\">Delhi Victims Compensation Scheme, 2018<\/a> vide which the definition of &#8220;Victim&#8221; and the provisions relating to &#8220;Interim Relief to Victims&#8221; has been revised. The provisions came into effect on 5-1-2024.<\/p>\n<p style=\"font-weight: bold;\">Key Points:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p><span style=\"font-weight: bold;\">Earlier<\/span>, the &#8220;Victim&#8221; meant any person who suffered loss or injury as a result of offence and in case of death of a person, the guardians or legal heir of that person was covered under the ambit of victim.<\/p>\n<p><span style=\"font-weight: bold;\">Now<\/span>, in addition to the above provision, some specific parameters have been determined that will make any person &#8220;Victim&#8221;, namely-<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Injury due to <span style=\"font-weight: bold;\">mob violence<\/span> and<\/p>\n<\/li>\n<li>\n<p>Injury due to <span style=\"font-weight: bold;\">mob lynching.<\/span><\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p>For the purpose of Compensation, the said victim should be treated as a victim by the Court or Investigating Agency.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Interim relief and the interim compensation<\/span>, in relation to injury due to mob violence\/ mob lynching, will be provided within 30 days from the date of offence.<\/p>\n<\/li>\n<li>\n<p>The minimum limit of interim compensation of Rs. 50000 <span style=\"font-weight: bold;\">will not apply<\/span> to the cases of mob violence\/ mob lynching victims.<\/p>\n<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\">The upper limits of compensation will be applicable as per the Schedule containing detailed specifications of various kinds of <span style=\"font-weight: bold;\">&#8220;Particulars of loss or injury&#8221;.<\/span><\/p>\n<\/li>\n<\/ol>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p style=\"font-style: italic;\">The definition of &#8220;Victim&#8221;
