The Court granted liberty to the petitioner to mention the matter for an early hearing on merits, indicating that the respondents have no right to be heard in the present application.<\/p>\n<p style=\"font-weight: bold;\">Brief Facts<\/p>\n<p style=\"margin-bottom: 3%;\">In the instant matter, the petitioner filed an application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519620\" target=\"_blank\" rel=\"noopener\">340<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> seeking a preliminary inquiry into alleged fraudulent and illegal acts by the respondents in connection with petition under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544910\" target=\"_blank\" rel=\"noopener\">11(6)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726958\" target=\"_blank\" rel=\"noopener\">Arbitration and Conciliation Act, 1996<\/a> (the Act), seeking the appointment of an arbitrator.<\/p>\n<p style=\"font-weight: bold;\">Parties&#8217; Contentions<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioner while citing various precedents, including <span style=\"font-style: italic;\">Pritish<\/span> v. <span style=\"font-style: italic;\">State of Maharashtra<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/8Xu7WDLE\" target=\"_blank\" rel=\"noopener\">(2002) 1 SCC 253<\/a>, contended that there is no obligation to provide an opportunity for hearing to the proposed accused at the pre-referral stage. The respondents emphasised on the wording of the provision, asserting that the term &#8220;inquiry&#8221; implies court intervention, requiring the proposed accused to be heard before initiating an inquiry into the offense.<\/p>\n<p style=\"font-weight: bold;\">Moot Point<\/p>\n<p style=\"margin-bottom: 3%;\">Whether respondents have right to be heard during the proceedings under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519620\" target=\"_blank\" rel=\"noopener\">340<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC?<\/a><\/p>\n<p style=\"font-weight: bold;\">Relevant Legal Provision<\/p>\n<p style=\"margin-bottom: 3%;\">Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519620\" target=\"_blank\" rel=\"noopener\">340(1)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> &#8212; outlines the court&#8217;s powers to order a preliminary inquiry into an offense referred to in Section 195(1)(b) in connection with a proceeding or document produced in court.<\/p>\n<p style=\"font-weight: bold;\">Court&#8217;s Observation<\/p>\n<p style=\"margin-bottom: 3%;\">The Court examined <span style=\"font-style: italic;\">Pritish<\/span> (Supra) where the Supreme Court emphasised that Section 340(1) does not mandate a hearing for the proposed accused at the pre-referral stage. The Court clarified that the preliminary inquiry&#8217;s purpose is not to decide guilt or innocence but to determine the need for an inquiry in the interest of justice. The Court highlighted key points from <span style=\"font-style: italic;\">Pritish<\/span> (Supra), including the discretionary nature of a preliminary inquiry, the absence of a mandatory requirement for a complaint, and the preservation of the accused&#8217;s right to be heard during subsequent proceedings before the Magistrate.
