S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001565518\" target=\"_blank\" rel=\"noopener\">142-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002780399\" target=\"_blank\" rel=\"noopener\">Customs Act, 1962<\/a>, does not alter this position. [<i>IDBI<\/i> v. <i>CCE &amp; Customs<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/u58Xs38c\" target=\"_blank\" rel=\"noopener\">(2023) 10 SCC 107<\/a>]<\/p>\n<\/div>\n<div style=\"border-bottom: 1px solid black; border-bottom-style: dashed;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726956\" target=\"_blank\" rel=\"noopener\">Hindu Marriage Act, 1955<\/a> &#8212; S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001543738\" target=\"_blank\" rel=\"noopener\">16<\/a> &#8212; Child born from void or voidable marriage conferred legitimacy under S. 16(1) or S. 16(2) HMA &#8212; Property that such child may inherit:<\/span> Such a child, held, will have rights to or in absolute and exclusive property of parents, but not in property of any other person. Property of the parents in which such child would have rights, held, includes share of parents in coparcenary property, though such child is not a coparcener in their own right.
