Delhi High Court: Prathiba M. Singh, J.<\/span>, opined that there appeared to be a need for some coordination between the Cyber Crime Cell of all Police Authorities and thus the Court directed Joint Secretary, Ministry of Home Affairs to call a meeting of all the Cyber Crime Cells in various states in order to have coordination between them for dealing with fraudulent transaction cases.<\/p>\n

In the present case, Hetu Arora Sethi, ASC submitted that in a number of cases, banks did not answer queries raised by the Police for ensuring compliance of orders passed by Police Authorities or Courts.<\/p>\n

The Court directed RBI to file a specific affidavit as to whether there were any guidelines which had been issued by it to banks in respect of queries raised by the Police and for ensuring compliance of any orders passed by police authorities or Courts. The Court also directed Banks to place their affidavits on the procedure they followed for replying to queries raised by the Police.<\/p>\n

The Court opined that whenever any information was requested by the Cyber Crime Cells of police authorities, banks ought to respond to the same in a diligent manner.<\/p>\n

Hetu Arora Sethi, ASC further submitted that in a number of cases, the ultimate accused were located in different states such as West Bengal, Bihar, Maharashtra etc., and it was difficult for the Delhi Police-Cyber Crime Cell to prosecute the cases in those states. The Court thus opined that there appeared to be a need for some coordination between the Cyber Crime Cell of all Police Authorities. The Court directed Joint Secretary, Ministry of Home Affairs to call a meeting of all the Cyber Crime Cells in various states in order to have some coordination between them for dealing with such fraudulent transaction cases.<\/p>\n
