On 20-11-2023, the Bombay City Civil Court (Amendment) Act, 2023 has received the assent of President in order to amend the Bombay City Civil Court Act, 1948<\/a>.<\/p>\n

Key Points:<\/p>\n

    \n
  1. \n

    Section 3 relating to “Constitution of Court”<\/span> has been revised. It provides for the jurisdiction to receive, try and dispose of all suits and other proceedings of civil nature arising within Greater Bombay.<\/p>\n

    Earlier, the jurisdiction of Court was on matters not exceeding Rs. 1 crore. Now, the limit has been extended to Rs. 10 crores.<\/p>\n<\/li>\n

  2. \n

    Exceptions-<\/span> Suits and proceedings which are cognizable:<\/p>\n

      \n
    • \n

      By the High Court-<\/span><\/p>\n

        \n
      • \n

        as a Court of Admiralty or Vice-Admiralty or as a Colonial Court of Admiralty, or as a Court having testamentary, intestate or matrimonial Jurisdiction;<\/p>\n<\/li>\n

      • \n

        for the relief of insolvent debtors;<\/p>\n<\/li>\n

      • \n

        under any special law other than the Letters Patent;<\/p>\n<\/li>\n

      • \n

        under the Pars Marriage and Divorce Act, 1936;<\/p>\n<\/li>\n

      • \n

        in respect of intellectual property matters.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

      • \n

        By the Small Causes Court<\/span>.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n

      • \n

        All the suits and proceedings cognizable by the Bombay City Civil Court which are pending in High Court will be transferred to Bombay City Civil Court on the date when the provisions of this Amendment Act will come into effect.<\/p>\n<\/li>\n<\/ol>\n<\/div>\n","protected":false},"excerpt":{"rendered":"
