Punjab and Haryana High Court:<\/span> In a petition under Section 439<\/a> of Criminal Procedure Code, 1973<\/a> (‘CrPC’) seeking regular bail for Ex- CIA In-charge Pritpal Singh accused of assisting the accused in Sidhu Moose Wala murder case in absconding from custody, involving offences under Sections 222<\/a>, 224<\/a>, 225-A<\/a>, 212<\/a>, 216<\/a> and 120-B<\/a> of Penal Code, 1860<\/a> (‘IPC’) and Sections 25<\/a>, 54<\/doclink> and 59<\/doclink> of Arms Act, 1959<\/a>, Mahabir Singh Sindhu, J. granted bail while noting that he had been in custody for more than a year, and charges were yet to be considered.<\/p>\n

The petitioner in the instant matter was accused of helping the accused in Sidhu Moose Wala murder case, a member of Lawrence Bishnoi gang who was involved in criminal cases like murder, attempt to murder, dacoity, etc., in absconding from custody in a very mischievous manner, who was taken by the In-Charge CIA Staff Mansa, SI Pritpal Singh regarding recovery of weapons from him. It was alleged that the said accused absconded from custody under a conspiracy, since the petitioner took him away alone in his private vehicle in the absence of any other security along with him.<\/p>\n

It was contended that the petitioner was in custody since 2-10-2022 and the charges were yet to be considered. In addition, the said run-away accused was re-arrested on 31-10-2022.<\/p>\n

The Court posted the instant matter to be next heard on 25-01-2024 and in the meantime, allowed the petitioner to be released on interim bail after furnishing bail bonds and surety bonds to the satisfaction of the Trial Court.<\/p>\n
