{"id":304896,"date":"2023-10-16T12:30:08","date_gmt":"2023-10-16T07:00:08","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=304896"},"modified":"2023-10-25T16:24:11","modified_gmt":"2023-10-25T10:54:11","slug":"chhattisgarh-hc-recording-phone-conversations-without-consent-violates-right-to-privacy-legal-news","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2023\/10\/16\/chhattisgarh-hc-recording-phone-conversations-without-consent-violates-right-to-privacy-legal-news\/","title":{"rendered":"Recording phone conversations without consent violates right to privacy under Article 21 of the Constitution: Chhattisgarh High Court"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Chhattisgarh High Court:<\/span> In a case wherein, the petitioner-wife had challenged the order dated 21-10-2021, whereby the application filed by the respondent-husband under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519587\" target=\"_blank\" rel=\"noopener\">311<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">Criminal Procedure Code, 1973<\/a> (\u2018CrPC\u2019) was allowed, <span style=\"font-weight: bold;\">Rakesh Mohan Pandey, J.<\/span>, opined that the husband had recorded wife\u2019s conversation without her knowledge and behind her back, which amounted to violation of her right to privacy and the right guaranteed under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574949\" target=\"_blank\" rel=\"noopener\">21<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution<\/a>. The Court opined that the Family Court, Mahasamund, Chhattisgarh (\u2018Family Court\u2019) had committed an error of law in allowing an application and thus, set aside the order passed by the Family Court on 21-10-2021.<\/p>\n<p style=\"font-weight: bold;\">Background<\/p>\n<p style=\"margin-bottom: 3%;\">In the instant case, the wife filed an application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519355\" target=\"_blank\" rel=\"noopener\">125<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> for the grant of maintenance, and the same was pending before the Family Court since 2019. The wife had submitted her evidence, thereafter the case was fixed for witnesses examination and production of documents.<\/p>\n<p style=\"margin-bottom: 3%;\">Meanwhile, the husband filed an application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519587\" target=\"_blank\" rel=\"noopener\">311<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> along with the certificate issued under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001516815\" target=\"_blank\" rel=\"noopener\">65-B<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726934\" target=\"_blank\" rel=\"noopener\">Evidence Act, 1872<\/a> (\u2018IEA\u2019) for the petitioner\u2019s re-examination on the ground that certain conversation was recorded on the mobile phone and he wanted to cross-examine the wife, confronting her with the said conversation. The Family Court vide order dated 21-10-2021, allowed the said application.<\/p>\n<p style=\"margin-bottom: 3%;\">Thus, the wife filed the petition before the present Court to challenge the order dated 21-10-2021.<\/p>\n<p style=\"margin-bottom: 3%;\">The wife contended that the conversation was recorded by the husband without her knowledge and the same could not be used against her, thus the Family Court had committed an error of law by allowing the application as it infringed her right to privacy.<\/p>\n<p style=\"font-weight: bold;\">Analysis, Law, and Decision<\/p>\n<p style=\"margin-bottom: 3%;\">The Court relied on <span style=\"font-style: italic;\">People\u2019s Union for Civil Liberties<\/span> v. <span style=\"font-style: italic;\">Union of India<\/span> <a href=\"https:\/\/www.scconline.com\/Members\/NoteView.aspx?enc=SlRYVC0wMDAwMDI0MzE5JiYmJiY0MCYmJiYmU2VhcmNoJiYmJiZmdWxsc2NyZWVuJiYmJiZmYWxzZSYmJiYmKDE5OTcpIDEgU0NDIDMwMSYmJiYmUGhyYXNlJiYmJiZGaW5kQnlDaXRhdGlvbiYmJiYmZmFsc2U=\" target=\"_blank\" rel=\"noopener\">(1997) 1 SCC 301<\/a>; <span style=\"font-style: italic;\">\u2018X\u2019<\/span> v. <span style=\"font-style: italic;\">Hospital \u2018Z\u2019<\/span> <a href=\"https:\/\/www.scconline.com\/Members\/NoteView.aspx?enc=SlRYVC0wMDAwMDI2Mjc1JiYmJiY0MCYmJiYmU2VhcmNoJiYmJiZmdWxsc2NyZWVuJiYmJiZmYWxzZSYmJiYmQUlSIDE5OTkgU0MgNDk1ICAgJiYmJiZQaHJhc2UmJiYmJkZpbmRCeUNpdGF0aW9uJiYmJiZmYWxzZQ==\" target=\"_blank\" rel=\"noopener\">(1998) 8 SCC 296<\/a> and <span style=\"font-style: italic;\">Anurima<\/span> v. <span style=\"font-style: italic;\">Sunil Mehta<\/span> <a href=\"https:\/\/www.scconline.com\/Members\/NoteView.aspx?enc=KDIwMTYpIDEgTVAgTEogMzMzJiYmJiY0MCYmJiYmU2VhcmNoUGFnZQ==\" target=\"_blank\" rel=\"noopener\">2015 SCC OnLine MP 7340<\/a> and opined that in the present case, it appeared that the husband had recorded the wife\u2019s conversation without her knowledge and behind her back, which amounted to violation of her right to privacy and also the right guaranteed under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574949\" target=\"_blank\" rel=\"noopener\">21<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further opined that the right to privacy was an essential component of right to life envisaged by Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574949\" target=\"_blank\" rel=\"noopener\">21<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution<\/a>, therefore the Family Court had committed an error of law in allowing an application under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519587\" target=\"_blank\" rel=\"noopener\">311<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> along with the certificate issued under Section 65-B of the IEA, and set aside the order passed by the Family Court on 21-10-2021.<\/p>\n<p style=\"margin-bottom: 3%;\">[<strong>Aasha Lata Soni v.
