Delhi High Court:<\/span> In a case wherein, the petition was filed under Section 482<\/a> of Criminal Procedure Code, 1973<\/a> seeking to quash the FIR registered under Sections 354<\/a>, 354-A<\/a>, 354-D<\/a>, 506<\/a> and 509<\/a> of the Penal Code, 1860<\/a> (‘IPC’), Jyoti Singh, J.*<\/span> while allowing the writ petition quashed the impugned FIR dated 10-11-2014 and further directed the accused to contribute Rs. 25,000 in form of woollen blankets.<\/p>\n

In the instant case, the accused against whom FIR was registered on complaint filed by a woman, submitted that with the passage of time and due to intervention of the relatives, common friends and families of the parties, the dispute between them was amicably settled and terms of such settlement was incorporated in the Settlement deed dated 30-02-2022. Further, the woman stated that since the matter was amicably settled between the parties, she had no objection if the present FIR was quashed, even though the matter was at the stage of final arguments before the Trial Court.<\/p>\n

The Court relied on Gian Singh<\/span> v. State of Punjab<\/span>, (2012) 10 SCC 303<\/a>, and opined that since the parties had mutually settled their disputes, so to put a rest to the litigation pending between them, this Court saw no reason to continue the proceedings. Therefore, in the interest of justice and to maintain the peace and harmony between the parties, the Court while allowing the writ petition quashed the impugned FIR dated 10-11-2014 and all the proceedings emanating therefrom.<\/p>\n

However, the Court directed the accused to contribute Rs. 25,000 in form of woollen blankets, and provide such blankets to Kilkari Rainbow Home for Girls, Kashmere Gate, Delhi, within four weeks from 25-09-2023. The Court further directed the accused to file a proof in support with the Registry within four weeks from 25-09-2023, and in case of failure to comply with the directions, the matter will be listed in the Court after four weeks.<\/p>\n
