Supreme Court:<\/span> A three Judge Bench comprising of Sanjay Kishan Kaul, Sanjiv Khanna and Bela M. Trivedi has been constituted to hear the review petitions against the landmark judgment in Vijay Madanlal Choudhary<\/span> v. Union of India<\/span>, 2022 SCC OnLine SC 929<\/a> , wherein the Court upheld the validity of certain impugned provisions of the Prevention of Money Laundering Act, 2002<\/a> (‘PMLA’) by holding that the same have reasonable nexus with the object sought be achieved i.e. combatting the menace of money laundering.<\/p>\n

The Bench will be hearing the matter from 18-10-2023.<\/p>\n

Previously, the division bench of Rohinton Nariman and Sanjay Kishan Kaul, JJ. had struck down Section 45(1)<\/a> of the PMLA<\/a> to the extent it imposed two additional conditions for grant of bail to money laundering accused and held that the twin conditions were arbitrary and discriminatory.<\/p>\n

However, this decision was overruled by a full bench of AM Khanwilkar, Dinesh Maheshwari and CT Ravikumar, JJ. in the case of Vijay Madanlal Choudhary (supra).<\/p>\n

Due to criticism of the ruling, several review petitions were filed, which will now be heard by the three-judge bench.<\/p>\n
