Sundar*<\/span> and R. Sakthivel, JJ., issued notice to the respondent, which was accepted by the Special Public Prosecutor for the NIA cases.<\/p>\n<p style=\"margin-bottom: 3%;\">The counsel for the appellant submitted that the appellant was secured and remanded to judicial custody in connection with alleged offences under Ss. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561375\" target=\"_blank\" rel=\"noopener\">120-B<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561415\" target=\"_blank\" rel=\"noopener\">153-A<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561416\" target=\"_blank\" rel=\"noopener\">153-AA<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\" target=\"_blank\" rel=\"noopener\">Penal Code, 1860<\/a> and Ss. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554025\" target=\"_blank\" rel=\"noopener\">13<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554030\" target=\"_blank\" rel=\"noopener\">17<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554031\" target=\"_blank\" rel=\"noopener\">18<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554033\" target=\"_blank\" rel=\"noopener\">18-B<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554060\" target=\"_blank\" rel=\"noopener\">38<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001554061\" target=\"_blank\" rel=\"noopener\">39<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002808781\" target=\"_blank\" rel=\"noopener\">Unlawful Activities (Prevention) Act, 1967<\/a>. It was submitted that appellant was secured and remanded to judicial custody on 09-05-2023 and that 90 days therefrom elapsed on 06-08-2023. However, a day before the elapse of the 90- days period, the NIA filed a petition under Section 43D(2)(b) First proviso of UAPA Act seeking extension of remand period from 90 days to 180 days, which was accepted by the Special Court.<\/p>\n<p style=\"margin-bottom: 3%;\">It was contended that that the impugned order came to be made when the appellant was not produced before the Trial Court. The counsel relied on number or precedents including <span style=\"font-style: italic;\">Judgebir Singh<\/span> v. <span style=\"font-style: italic;\">National Investigation Agency<\/span>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/t0pePr34\" target=\"_blank\" rel=\"noopener\">2023 SCC OnLine SC 543<\/a>, wherein the Supreme Court in an <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/06\/19\/no-extension-of-time-for-investigation-should-be-prayed-for-at-the-last-moment-sc-legal-news\/\" target=\"_blank\" rel=\"noopener\">eye-opening decision<\/a> made it clear that such petitions should not be filed at the eleventh hour.<\/p>\n<p style=\"margin-bottom: 3%;\">It was also submitted that the report of the Prosecutor vis-a-vis extension under Section 43D(2)(b) first proviso of UAPA Act has not been supplied to the appellant.<\/p>\n<p style=\"margin-bottom: 3%;\">Perusing the facts and submissions, the Court was of the view that a prima facie case can be made out and hence issued notice to the respondents regarding the same.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Sathik Ali v.
