{"id":300297,"date":"2023-08-29T13:00:32","date_gmt":"2023-08-29T07:30:32","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=300297"},"modified":"2023-08-29T18:07:28","modified_gmt":"2023-08-29T12:37:28","slug":"madhya-pradesh-hc-quashed-fir-and-criminal-proceeding-due-to-misuse-section-498a-of-ipc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2023\/08\/29\/madhya-pradesh-hc-quashed-fir-and-criminal-proceeding-due-to-misuse-section-498a-of-ipc\/","title":{"rendered":"Misuse of Section 498-A IPC| Madhya Pradesh High Court quashes criminal case against in-laws, calls it \u201ca case of reverse cruelty\u201d"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Madhya Pradesh High Court: <\/span>While dealing with a case of quashment of an FIR filed under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561850\">498-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\">Penal Code, 1860<\/a> (IPC), which pertained to dowry-related offenses and cruelty, a single-judge bench comprising of <span style=\"font-weight: bold;\">Vivek Rusia,*<\/span> J., observed the misuse of Section 498-A and considered the jurisdiction, venue, and merits of the case before quashing the FIR and related proceedings due to the absence of credible evidence and jurisdictional issues.<\/p>\n<p style=\"font-weight: bold;\">Brief Facts<\/p>\n<p style=\"margin-bottom: 3%;\">In the instant matter, the petitioner 1 married respondent 2 in Indore on 22-6-2017. Respondent 2 filed an FIR alleging that her husband-petitioner 1, his parents, and others demanded money and ill-treated her for dowry after the marriage. The FIR was registered in Indore despite the fact that none of the offenses were alleged to have occurred there. The petitioners were residents of Gurgaon, and respondent 2&#39;s parents were from Navi Mumbai.<\/p>\n<p style=\"margin-bottom: 3%;\">The allegations included a demand for Rs. 10 lakhs and a car, along with allegations of cruelty. The respondent 2 also alleged that her husband Kartik Mathur left for Australia, citing unhappiness due to unmet dowry demands.<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioners filed present petitions under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\">CrPC<\/a> seeking the quashment of FIR registered based on a complaint filed by respondent 2. The complaint alleged offenses under sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561850\">498-A<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561632\">323<\/a>, and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561652\">34<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\">Penal Code, 1860<\/a> (IPC) at Police Station Mahila Thana, Indore.<\/p>\n<p style=\"font-weight: bold;\">Moot Point<\/p>\n<p style=\"margin-bottom: 3%;\">Whether the FIR filed by respondent 2, which includes allegations of dowry demands, cruelty, and offenses under sections <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561850\">498-A<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561632\">323<\/a>, and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561652\">34<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\">IPC<\/a>, should be quashed?<\/p>\n<p style=\"font-weight: bold;\">Contentions<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioners contended that they were permanent residents of Gurgaon, and the allegations in the FIR pertained to events in Gurgaon and not Indore. The delay in filing the FIR and the possibility of misuse of Section 498-A were raised.<\/p>\n<p style=\"margin-bottom: 3%;\">The respondents contended that the allegations required detailed evidence, which couldn&#8217;t be assessed at this stage. It was further contended that the Court should not interfere prematurely.<\/p>\n<p style=\"font-weight: bold;\">Court&#39;s Observation and Decision<\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that the parties had settled in Australia and that the parents of the husband were being harassed by the Indian legal proceedings. The Court stated that this case has now become <span style=\"font-weight: bold;\">&#8220;a case of reverse cruelty&#8221;<\/span> upon the petitioner 1&#39;s parents as the parties are residing outside India and they are made to suffer in India by way of criminal or matrimonial litigation.<\/p>\n<p>The Court observed that there is no specific allegation that when the husband left India for Australia there was any demand for dowry, etc. The Court observed that Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561850\">498-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\">IPC<\/a> is often misused and caused undue harassment. The Court stated that<\/p>\n<p style=\"margin-bottom: 3%; margin-left: 18pt; font-weight: bold;\">&#8220;&#8230;where there is apparent misuse of Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001561850\">498-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726960\">Penal Code, 1860<\/a> the High Court should exercise the power conferred under section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519791\">482<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\">Cr.P.C.<\/a> to protect the relatives of the husband in matrimonial dispute in order to do the complete justice and prevent misuse of the process of law.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">Considering the allegations and the delay in filing the FIR, the Court held that the FIR was filed with the intention to harass the accused. The Court further noted that the allegations related to acts outside Indore and therefore, the FIR&#8217;s registration in Indore was incorrect.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court allowed the petitions and quashed the FIR and the subsequent proceedings.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Rajan v.
