There should be fairness, there should be rule of law. When it comes to dispute resolution, the larger challenge is that there is no statute\u201d. Justice Bakhru also said that the due process is a procedure, a system that embodies justice. One cannot give an exhaustive definition to it.<\/p>\n<p style=\"margin-bottom: 3%;\">He further said that if there is robust due process in place, we will have less paranoia and hence, it&#8217;s the paranoia that needs to be addressed.<\/p>\n<p style=\"margin-bottom: 3%;\">On the question relating to training of arbitrators, Justice Bakhru said that \u201ctraining surely will help, but we need the bandwidth to run this\u201d.<\/p>\n<p style=\"margin-bottom: 3%;\"><a href=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2023\/08\/Press-Release-AD-3.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-299910\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2023\/08\/Press-Release-AD-3.jpg\" alt=\"\" width=\"322\" height=\"399\" \/><\/a><\/p>\n<p style=\"margin-bottom: 3%;\">Concerning due process paranoia, <span style=\"font-weight: bold;\">Professor Doug Jones<\/span> said that Courts had a limited involvement in arbitration. The reason is that in many jurisdictions, the judges have taken a view that the arbitrator must take the process with which they are familiar. The duty of an Arbitrator is to produce an award which is enforceable at the place of arbitration.<\/p>\n<p style=\"margin-bottom: 3%;\">Further, he said that \u201carbitration can be flexible as to the need of the issue\u201d.<\/p>\n<p style=\"margin-bottom: 3%;\"><a href=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2023\/08\/Press-Release-AD-4.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-299911\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2023\/08\/Press-Release-AD-4.jpg\" alt=\"\" width=\"300\" height=\"428\" \/><\/a><\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Professor Janet Walker <\/span>said that \u201cthere are many kinds of approaches to arbitration around the world\u201d. As per her one of the most common features of paranoia is late filing of submissions, producing incomplete documents.<\/p>\n<p style=\"margin-bottom: 3%;\"><a href=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2023\/08\/Press-Release-AD-5.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-299912\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2023\/08\/Press-Release-AD-5.jpg\" alt=\"\" width=\"326\" height=\"435\" srcset=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2023\/08\/Press-Release-AD-5.jpg 510w, https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2023\/08\/Press-Release-AD-5-225x300.jpg 3%;\"><span style=\"font-weight: bold;\">Justice Sachin Datta, Judge, Delhi High Court <\/span>focused on converting the due process into absolute process, as sometimes due process requests can have a disruptive effect on arbitration.<\/p>\n<p style=\"margin-bottom: 3%;\">Concerning the question on what Tribunals should keep in mind to follow due process, Justice Datta said that \u201cTribunals must maintain absolute transparency, they must be both proactive and interactive\u201d.<\/p>\n<p style=\"margin-bottom: 3%;\"><a href=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2023\/08\/Press-Release-AD-6.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-299913\"
