About the Organiser<\/p>\n

With the legacy of 38 years, NMIMS has grown to be not only one of the top-10 B-schools in India but also emerged as a multi-disciplinary, multi-campus University and fourteen constituent schools, of which Kirit P. Mehta School of Law is one.<\/p>\n

Established in the year 2013 approved by the Bar Council of India aims to provide a Law School with a global focus and international outreach dedicated to advancing human dignity, social and economic welfare, and justice through knowledge of the law. <\/p>\n

About the International Moot Court Competition<\/p>\n

The first ever International Moot Court Competition was held on the theme of ‘Data Privacy' in 2019. The second international competition was held on the theme of ‘International Environment Law' which was originally scheduled for March 2020 but since we were hit by the pandemic, the competition was successfully concluded on a virtual platform in August 2020. In 2021, the third edition of the competition was held on the theme of ‘International Investment v. National Security'.<\/p>\n

The previous edition in 2022 was held on the theme of ‘International Crimes', saw a participation of over 30+ teams from across the world with pertinent teams from international institutions being a part of the competition. <\/p>\n

The SVKM's NMIMS Kirit P. Mehta School of Law's 5th International Moot Court Competition, 2023 is scheduled from August 11 to 13, 2023 on the theme of Investment Treaty Arbitration. The proposition for this edition has been drafted by the esteemed Ms. Priyanka Shetty, Partner, AZB & Partners.<\/p>\n

About the Theme<\/p>\n

Theme for the 5th International Moot Court Competition is Investment Treaty Arbitration.<\/span><\/p>\n

The area of law concerning International investment  is presently the most innovative, fastest developing and intellectually challenging branch of international law with high practical relevance. The number of investment disputes before international arbitral tribunals has increased significantly over the past few decades and reflects the notable preferences of the international business community for resolving international investment disputes. The moot proposition is founded on a Bilateral Investment Treaty between Nigen and Ketterdam for the sustainable extraction of oil and energy resources. Notably, both Nigen and Ketterdam are parties to the 1958 Convention on the Recognition and Enforcement of Foreign Arbitral Awards (the “New York Convention”) and have adopted the 1985 UNCITRAL Model Law on International Commercial Arbitration (with the 2006 amendments) in their domestic statutes governing arbitration.<\/p>\n

With this background, the moot proposition for the 5th International Moot Court Competition has inculcated the issues relating to such treaties and put forth such a situation to be discussed and decided by International Arbitration Mechanism.<\/p>\n
