Supreme Court:<\/b> In a matter concerning the film \u2018Adipurush\u2019, the division bench of SK Kaul and Sudhanshu Dhulia, JJ. has granted interim relief to the makers of the film by staying all High Court proceedings. The Bench also, issued notice in the plea challenging the order passed by Allahabad High Court, wherein the Court directed the Director of the film, and the dialogues writer of the film to appear in person along with their personal affidavits explaining their bonafide. Further, the Court issued notice on a separate transfer petition filed by the producer of the film for transferring the proceedings of the movie in different High Courts to the Supreme Court.<\/p>\n

The petitions are pending in the High Courts of Rajasthan, Punjab & Haryana and Allahabad seeking to ban the movie and quash the Central Board of Film Certification (\u2018CBFC\u2019) certification granted to it.<\/p>\n

In its order, the Allahabad High Court reiterated that in the name of freedom of speech and expression no one can be permitted to do anything which is against the decency or morality or against the public order etc. This film, prima facie, do not qualify the test as prescribed under Article 19<\/a> of the Constitution of India<\/a>. The High Court sought the personal presence of movie Director, Producer and Dialogue Write for explanation. The matter will be heard on 27-07-2023<\/p>\n

The Supreme Court has also dismissed another writ petition which was filed against the certification granted to the movie, as under Article 32<\/a> of the Constitution of India<\/a>, the Court cannot interfere in the decision taken by a statutory body. Further, it said that it was inappropriate for the Supreme Court to interfere with film certifications based on the \u201csensitivities of each individual\u201d.<\/p>\n
