He practiced law at the Principal Seat of the Gauhati High Court in Guwahati and appeared before its Benches in Agartala, Shillong, Kohima, and Itanagar. Vasanta Mogli<\/i> v. <i>State of Telangana<\/i>, W.P. (PIL) No. 44 of 2018, decided on 6-7-2023<\/span>, a case wherein prayer was made to declare <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000476838\" target=\"_blank\" rel=\"noopener\">Telangana Eunuchs Act, 1329<\/a> Fasli (&#8216;Telangana Eunuchs Act&#8217;) as ultra vires and unconstitutional, a Division Bench of <span style=\"font-weight: bold;\">Ujjal Bhuyan, CJ.*<\/span> and C.V. Bhaskar Reddy, J., opined that the <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/07\/11\/telangana-hc-declares-telangana-eunuchs-act-as-unconstitutional-legal-news\/\" target=\"_blank\" rel=\"noopener\">Telangana Eunuchs Act was violative of the human rights of the third gender community<\/a> besides being an intrusion into their private sphere as well as an assault on their dignity. It was thus offensive of both right to privacy and right to dignity of transgender persons. Moreover, it was not only violative of Article 14 but also clearly violated Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574949\" target=\"_blank\" rel=\"noopener\">21<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution<\/a>. Thus, the Court opined that such an enactment could no longer continue to find a place in our statute book and thus, was accordingly declared as unconstitutional.<\/p>\n<p style=\"margin-left: 36pt; font-weight: bold; margin-bottom: 3%;\">&#8220;Constitutional morality impacts upon any law which deprives the LGBT individuals of their entitlement to a full and equal citizenship. LGBT individuals living under threats of conformity grounded in cultural morality have been denied basic human existence. Constitutional morality does not permit such discrimination and must supersede cultural morality.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><i>SKS Micro Finance Ltd.<\/i> v. <i>State of A.P.<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/ci4im872\" target=\"_blank\" rel=\"noopener\">2023 SCC OnLine AP 285<\/a><\/span>, a case wherein the <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/02\/22\/the-andhra-pradesh-micro-finance-institutions-regulation-of-money-lending-act-2011-and-the-telangana-micro-finance-institutions-regulation-of-money-lending-act-2011-are-not-unconstitutional-telangana\/\" target=\"_blank\" rel=\"noopener\">constitutional validity of the Andhra Pradesh Micro Finance Institutions (Regulation of Money Lending) Act, 2011 was challenged<\/a> on the ground that it was beyond the legislative competence of the Andhra Pradesh Legislature, the Division Bench of <span style=\"font-weight: bold;\">Ujjal Bhuyan,* C.J.<\/span> and C.V. Bhaskar Reddy, J. refused to declare the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000404731\" target=\"_blank\" rel=\"noopener\">Andhra Pradesh Micro Finance Institutions (Regulation of Money Lending) Act, 2011<\/a> and the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000493847\" target=\"_blank\" rel=\"noopener\">Telangana Micro Finance Institutions (Regulation of Money Lending) Act, 2011<\/a> as unconstitutional and held that the NBFCs operating in the States of Telangana and Andhra Pradesh registered with the RBI would be excluded from the purview of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000404731\" target=\"_blank\" rel=\"noopener\">Andhra Pradesh Micro Finance Institutions (Regulation of Money Lending) Act, 2011<\/a> and the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000493847\" target=\"_blank\" rel=\"noopener\">Telangana Micro Finance Institutions (Regulation of Money Lending) Act, 2011<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">While allowing the instant petition filed under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574969\" target=\"_blank\" rel=\"noopener\">226<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution of India<\/a> in <span style=\"font-weight: bold;\"><i>Srico Projects (P) Ltd<\/i>. v. <i>Telangana State Authority for Advance Ruling<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/aAyv9Nj1\" target=\"_blank\" rel=\"noopener\">2022 SCC OnLine TS 1527<\/a><\/span>, for quashing the impugned order dated 03-06-2022 passed by Telangana State Authority for Advance Ruling (&#8216;Authority&#8217;) and to consider the application for advance ruling under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002534844\" target=\"_blank\" rel=\"noopener\">98<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002896482\" target=\"_blank\" rel=\"noopener\">Central Goods and Services Tax Act, 2017<\/a> (&#8216;CGST&#8217;), the division bench of <span style=\"font-weight: bold;\">Ujjal Bhuyan*, C.J.<\/span>, and C.V. Bhaskar Reddy, J., held that <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/09\/01\/telangana-state-authority-advanceruling-cgst-investigation-post-filing-application-not-debar-seekingadvanceruling-telanganahighcourt-legal-updates-research-news\/\" target=\"_blank\" rel=\"noopener\">the investigation post filing of the application will not debar the applicant from seeking an advance ruling<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><i>VANPIC Ports (P) Ltd.<\/i> v. <i>Directorate of Enforcement<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/H43U77KK\" target=\"_blank\" rel=\"noopener\">2022 SCC OnLine TS 1793<\/a><\/span>, a <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/06\/21\/landmark-judgments-on-prevention-of-money-laundering-act-by-the-sc-and-hcs-in-2022-part-iii\/\" target=\"_blank\" rel=\"noopener\">landmark judgment on Prevention of Money-Laundering Act, 2002<\/a> (PMLA), a Division bench comprising of <span style=\"font-weight: bold;\">Ujjal Bhuyan,* C.J<\/span>. and Surepalli Nanda, J., while interpreting Sections 5 and 8 of the PMLA, the Court held that on the anvil of both provisions, it was to be examined whether ATPMLA had erred in abdicating its adjudicatory functions, whilst relegating the appellant to Special Court for seeking release of attached properties after having found the attachment to be illegal. The sine qua non for exercising powers under Section 5(1) was found to be that attaching authorities must have &#8220;reasons to believe&#8221;, recorded in writing, as the basis for inferring that the person is in possession of proceeds of crime, which are likely to be concealed. The reasons to believe must have direct nexus or live link with the material in possession pertaining to above two aspects.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><i>V. Vijay Sai Reddy<\/i> v. <i>Enforcement Directorate<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/2Z8QwABL\" target=\"_blank\" rel=\"noopener\">2022 SCC OnLine TS 1604<\/a><\/span>, a single bench of <span style=\"font-weight: bold;\">Ujjal Bhuyan,* C.J<\/span>., while <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/06\/17\/landmark-judgments-on-prevention-of-money-laundering-act-by-the-sc-and-hcs-in-2022-part-ii\/\" target=\"_blank\" rel=\"noopener\">interpreting various provisions of PMLA<\/a>, specially the non obstante clause of Section 44, held that trial of both the offences viz. that of scheduled\/predicate offence and the other one of PMLA offence has to be carried out before the same court. The case related to scheduled\/predicate offence even if being tried in another court shall stand committed to the Special Court where the trial arising out of PMLA offence is instituted or pending.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><i>Ritika Prashant Jasani<\/i> v. <i>Anjana Niranjan Jasani<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/6KQ8r1g5\" target=\"_blank\" rel=\"noopener\">2021 SCC OnLine Bom 1802<\/a><\/span>, a Division bench of <span style=\"font-weight: bold;\">Ujjal Bhuyan*<\/span> and Madhav J. Jamdar, JJ., while <a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/08\/19\/shared-household-2\/\" target=\"_blank\" rel=\"noopener\">explaining the provisions under Maintenance and Welfare of Parents and Senior Citizens Act, 2007<\/a> also elaborated upon the concept of shared household and remanded the matter back to the Tribunal for Maintenance and Welfare of Parents and Senior Citizens.<\/p>\n<p style=\"margin-bottom: 3%;\">While deciding <a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/06\/29\/cruelty-and-desertion\/\" target=\"_blank\" rel=\"noopener\">whether wife&#8217;s wish to stay abroad is an act of selfishness and can be a ground for divorce<\/a> in <span style=\"font-weight: bold;\"><i>Prakashchandra Joshi<\/i> v. <i>Kuntal Prakashchandra Joshi<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/iV8aUvK8\" target=\"_blank\" rel=\"noopener\">2021 SCC OnLine Bom 958<\/a><\/span>, a Division Bench of Ujjal Bhuyan and Prithviraj K. Chauhan, JJ., held that wife wishing to stay abroad with the child to maintain her status would not amount to cruelty and desertion when she was already well settled over there.<\/p>\n<p style=\"\">In <span style=\"font-weight: bold;\"><i>Dharmendra M. Jani<\/i> v. <i>Union of India<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/1NnwJsW7\" target=\"_blank\" rel=\"noopener\">2021 SCC OnLine Bom 839<\/a><\/span>, the Division Bench of Ujjal Bhuyan and Abhay Ahuja, JJ., gave a <a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/06\/17\/igst-act\/\" target=\"_blank\" rel=\"noopener\">splitting verdict on the constitutionality of Sections 13(8)(b) and 8(2) of the Integrated Goods and Services Tax Act, 2017<\/a>. Ujjal Bhuyan, J., held that Section 13(8)(b) of the IGST Act, 2017 was ultra vires the said Act besides being unconstitutional. However, Abhay Ahuja, J., stated that he was unable to share the opinion of Justice Ujjal Bhuyan.<\/p>\n<p style=\"margin-left: 36pt; font-weight: bold; margin-bottom: 3%;\">&#8220;By artificially creating a deeming provision in the form of Section 13(8)(b) of the IGST Act, where the location of the recipient of service provided by an intermediary is outside India, the place of supply has been treated as the location of the supplier i.e., in India. This runs contrary to the scheme of the CGST Act as well as the IGST Act besides being beyond the charging sections of both the Acts.&#8221;<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\"><i>Parents Teachers Assn. of United Forum<\/i> v. <i>State of Maharashtra<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/xEPz665E\" target=\"_blank\" rel=\"noopener\">2020 SCC OnLine Bom 793<\/a><\/span>, a Division Bench of Ujjal Bhuyan and N.R. Borkar, JJ., has directed State of Maharashtra to <a href=\"https:\/\/www.scconline.com\/blog\/post\/2020\/07\/14\/bom-hc-no-coercive-action-against-schools-for-providing-online-classes-to-pupils-below-class-ii-similarly-schools-not-to-take-action-against-parents-unwilling-to-avail-online-classes\/\" target=\"_blank\" rel=\"noopener\">not take any coercive action against the schools for providing online teaching<\/a> to pupils belonging to Class-II and below who are willing to avail such teaching.
