{"id":294713,"date":"2023-06-15T16:00:11","date_gmt":"2023-06-15T10:30:11","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=294713"},"modified":"2023-06-15T15:47:45","modified_gmt":"2023-06-15T10:17:45","slug":"violation-of-fundamental-right-a-pre-requisite-to-invoke-article-226-gauhati-hc","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2023\/06\/15\/violation-of-fundamental-right-a-pre-requisite-to-invoke-article-226-gauhati-hc\/","title":{"rendered":"Gauhati HC answers whether extraordinary jurisdiction under Art 226 of the Constitution can be invoked for trivial causes"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><b>Gauhati High Court:<\/b> While dismissing a writ petition filed for reassessment of the Assam High School Board Examination, a Single Judge Bench of Sanjay Kumar Medhi J. opined that the extraordinary jurisdiction under Article <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001574969\" target=\"_blank\" rel=\"noopener\">226<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726967\" target=\"_blank\" rel=\"noopener\">Constitution<\/a> cannot be invoked for resolution of each and every dispute.<\/p>\n<p style=\"margin-bottom: 3%;\">Petitioner&#8217;s daughter in the present case appeared in Assam High School Leaving Certificate Examination (HSLC) 2021, due to peculiar situation of Covid-19, the exam was initially postponed and then eventually cancelled. A set of guidelines were issued for the evaluation of result, which was to be done based on the performance in previous examination. When the result was declared however, the candidate was shown as &#8216;failed&#8217;. Thereafter, the petitioner filed a writ petition in the High Court alleging that the evaluation has not been done on the set criteria.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court rejected the contention and opined that, in the view of such poor performance by the candidate in the previous examination evident from the mark sheet, whether at all this writ petition should be entertained has become questionable.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court held, that the petitioners were unable to prove the violation of any fundamental or legal right which is pre-requisite for invoking Article 226 and the present challenge is not only misconceived but also an abuse of process. Thus, the petition was dismissed and a cost of Rs. 10,000 was imposed on petitioners.<\/p>\n<p style=\"margin-bottom: 3%;\">Petition Dismissed.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Hilal Udin Tapadar v. Numerous cases has been filled with imaginary and very trivial causes of action. The court is of the opinion that such trend should be nipped in the bud and filling of writ petition of this nature has to be
