{"id":294254,"date":"2023-06-09T12:00:52","date_gmt":"2023-06-09T06:30:52","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=294254"},"modified":"2023-06-09T09:51:27","modified_gmt":"2023-06-09T04:21:27","slug":"calcutta-high-court-upheld-trial-court-order-scc-blog-legal-research-news","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2023\/06\/09\/calcutta-high-court-upheld-trial-court-order-scc-blog-legal-research-news\/","title":{"rendered":"Section 138 NI Act| No mandatory disposal of Section 143A application before examination of accused under Section 251 CrPC: Calcutta High Court"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><b>Calcutta High Court:<\/b> The single judge bench of <b>Bibek Chaudhuri<\/b>,* J. has held that an application under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002899816\" target=\"_blank\" rel=\"noopener\">143-A<\/a> of <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726957\" target=\"_blank\" rel=\"noopener\">Negotiable Instruments Act, 1881<\/a> is not needed to be disposed of on the date of examination of the accused under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519506\" target=\"_blank\" rel=\"noopener\">251<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>, the same can be disposed of at any point of time.<\/p>\n<p><b>Factual Matrix<\/b><\/p>\n<p style=\"margin-bottom: 3%;\">In the instant matter, the opposite party-complainant filed a complaint against the petitioner-accused under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544366\" target=\"_blank\" rel=\"noopener\">138<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726957\" target=\"_blank\" rel=\"noopener\">NI Act<\/a> when the complainant deposited the cheque issued by the petitioner as the payment for the order of N-95 (5 layers) Mask and Surgical Mask for encashment and the same was dishonored due to insufficiency of fund. The complainant was examined under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519450\" target=\"_blank\" rel=\"noopener\">200<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> and filed her evidence on affidavit in terms of S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001544375\" target=\"_blank\" rel=\"noopener\">145(1)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726957\" target=\"_blank\" rel=\"noopener\">NI Act<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">The Judicial Magistrate vide order dated 07-10-2021, allowed the application filed by the complainant under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002899816\" target=\"_blank\" rel=\"noopener\">143-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726957\" target=\"_blank\" rel=\"noopener\">NI Act<\/a> for payment of interim compensation by the accused without mentioning any mode of payment. The accused was examined under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519506\" target=\"_blank\" rel=\"noopener\">251<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> and the Judicial Magistrate vide order dated 03-12-2021, refused the accused petition praying for modification of the order dated 07-10-2021 and fixed the next date of the hearing on 15-03-2022.<\/p>\n<p style=\"margin-bottom: 3%;\">Aggrieved by the impugned orders dated 07-10-2021 and 03-12-2021 passed by the Judicial Magistrate, the accused preferred the present revision application and contended that the Judicial Magistrate made an error in passing the impugned orders as the application under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002899816\" target=\"_blank\" rel=\"noopener\">143-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726957\" target=\"_blank\" rel=\"noopener\">NI Act<\/a> was not heard and disposed of.<\/p>\n<p><b>Observation<\/b><\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002899816\" target=\"_blank\" rel=\"noopener\">143-A(a) and (b)<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726957\" target=\"_blank\" rel=\"noopener\">NI Act<\/a> empowers the Court to order the drawer of the cheque to pay interim compensation to the complainant where the accused pleads not guilty to the accusations made in the complaint.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court remarked that it is not mandatory that on the date of examination of the accused under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519506\" target=\"_blank\" rel=\"noopener\">251<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a>, the application under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002899816\" target=\"_blank\" rel=\"noopener\">143-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726957\" target=\"_blank\" rel=\"noopener\">NI Act<\/a> should be disposed of, it can be disposed of at any point of time.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court observed that the accused&#8217;s opportunity to cross-examine the complainant (PW1) was taken away from him by fixing the next date for examination of the accused under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519590\" target=\"_blank\" rel=\"noopener\">313<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">CrPC<\/a> and hearing of the petition under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002899816\" target=\"_blank\" rel=\"noopener\">143-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726957\" target=\"_blank\" rel=\"noopener\">NI Act<\/a>.<\/p>\n<p><b>Verdict<\/b><\/p>\n<p style=\"margin-bottom: 3%;\">While disposing of the present revision, the Court, for ends of justice, directed the Trial Court to give opportunity to the accused to cross-examine PW1 and disposed of the application under S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002899816\" target=\"_blank\" rel=\"noopener\">143-A<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726957\" target=\"_blank\" rel=\"noopener\">NI Act<\/a> without giving any adjournment to either of the parties.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Susanta Chakraborty v.
