Under new Amendment as envisaged by the SB-1070, new provisions have been added, however the focus has been on introduction of a Private Sector Data System to identify voters. So far, the Senate Bill has the approval of the House, it is yet to pass the scrutiny by the Governor, upon whose approval this Bill will be converted into Law<a id=\"fnref1\" href=\"#fn1\" title=\"1. Texas Legislature Online - 88(R) Bill Stages for SB 1070\"><sup>1<\/sup><\/a>. If approved, the law will then come into effect on 01-09-2023. <\/p>\n<p style=\"text-align: center; font-weight: bold; color: #c00000;\">Section 18.062 of Election Code as it stands now<a id=\"fnref2\" href=\"#fn2\" title=\"2. ELECTION CODE CHAPTER 18. PROCEDURES FOR IDENTIFYING REGISTERED VOTERS (texas.gov)\"><sup>2<\/sup><\/a><\/p>\n<p style=\"font-weight: bold;\">Interstate Voter Registration Crosscheck Programme.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(a) To maintain the state-wide voter registration list and to prevent duplication of registration in more than one state or jurisdiction, the secretary of state shall cooperate with other states and jurisdictions to develop systems to compare voters, voter history, and voter registration lists to identify voters whose addresses have changed.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">(b) A system developed under this section must comply with the National Voter Registration Act (52 U.S.C. Section 20501 et seq.)<\/p>\n<p style=\"text-align: center; font-weight: bold; color: #c00000;\">Important Additions and Changes in Section 18.062 after SB 1070 Amendments<a id=\"fnref3\" href=\"#fn3\" title=\"3. 88(R) SB 1070 - Introduced version (texas.gov)\"><sup>3<\/sup><\/a><\/p>\n<p style=\"margin-bottom: 3%;\">As per new provision <span style=\"font-weight: bold;\">(a-1)<\/span>, in order to prevent duplication of registration in more than one state or jurisdiction the Secretary of State must cooperate not only to compare voters, voter history, and voter registration lists to identify voters whose addresses have changed, <span style=\"font-weight: bold;\">but also identify &#8211; Voters who have been convicted of a felony; or Voters who are registered to vote in more than one State<\/span>.<\/p>\n<p style=\"text-align: center; font-weight: bold; color: #c00000;\">Introducing a Private Data System to identify voters-<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p>Under newly added provision <span style=\"font-weight: bold;\">(a-2)<\/span> the Secretary of State will also have to <span style=\"font-weight: bold;\">identify and contract with the provider of a private sector data system to identify voters<\/span>.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">Furthermore, such private sector data system must have demonstrated an ability to work with registered voter identification and matching systems.<\/span><\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">A private system so developed must comply with the National Voter Registration Act of 1993 (52 U.S.C. Section 20501 et seq.) and the Help America Vote Act of 2002 (52 U.S.C. Section 20901 et seq)<\/span>.<\/p>\n<\/li>\n<li>\n<p><span style=\"font-weight: bold;\">The Secretary of State may not provide to a system under Subsection (a)(2) any information that is not:<\/span><\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\"><span style=\"font-weight: bold;\">(1) found in a voter roll; and<\/span><\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\"><span style=\"font-weight: bold;\">(2) necessary to identify voters under Subsection (a)(2).<\/span><\/p>\n<\/li>\n<li>\n<p>The Secretary of State shall record information related to the system under Sub-section (a)(2) and shall submit to the legislature a report on that information not later than the first day of each quarter of the state&#8217;s fiscal year.<\/p>\n<\/li>\n<li>\n<p>A contract with a system under Sub-section (a)(2) may not require any additional duty of the state not required by this section.<\/p>\n<\/li>\n<\/ul>\n<\/div>\n<hr\/>\n<p style=\"margin-left: 18pt; text-indent: -18pt;\"><a id=\"fn1\" href=\"#fnref1\">1.<\/a> <a href=\"https:\/\/capitol.texas.gov\/billlookup\/BillStages.aspx?LegSess=88R&amp;Bill=SB1070\" target=\"_blank\" rel=\"noopener\">Texas Legislature Online &#8211; 88(R) Bill Stages for SB 1070<\/a><\/p>\n<p style=\"margin-left: 18pt; text-indent: -18pt;\"><a id=\"fn2\" href=\"#fnref2\">2.<\/a> <a href=\"https:\/\/statutes.capitol.texas.gov\/Docs\/EL\/htm\/EL.18.htm#18.062\" target=\"_blank\" rel=\"noopener\">ELECTION CODE CHAPTER 18.
