[<i>Ram Shridhar Chimurkar<\/i> v. <i>Union of India<\/i>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001458314\" target=\"_blank\" rel=\"noopener\">(2023) 4 SCC 312<\/a>]<\/p>\n<\/div>\n<div style=\"border-bottom: 1px solid black; border-bottom-style: dashed;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9000055985\" target=\"_blank\" rel=\"noopener\">Companies Act, 1956<\/a> &#8212; S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001517333\" target=\"_blank\" rel=\"noopener\">111-A<\/a> &#8212; [Corresponding to S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001537727\" target=\"_blank\" rel=\"noopener\">59<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002766251\" target=\"_blank\" rel=\"noopener\">Companies Act, 2013<\/a>] &#8212; Rectificatory jurisdiction &#8212; Nature and scope:<\/span> The provisions re the exercise of rectificatory powers of a Board\/Company Court under S. 38 of the Companies Act, 1913, then under S. 155 of the 1956 Act, followed by S. 111-A introduced by the 1996 Amendment to the 1956 Act, and finally, S. 59 of the 2013 Act, held, demonstrate that its essential ingredients have remained the same, and it is a summary power to carry out corrections or rectifications in the register of members. Held, the rectification must relate to and be confined to the facts that are evident and need no serious enquiry. Further, in a case of violation of the SEBI Regulations, CLB cannot exercise rectificatory jurisdiction unless and until SEBI, in the very first instance, decides if there has been a violation or not. [<i>IFB Agro Industries Ltd.<\/i> v. <i>SICGIL India Ltd.<\/i>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001458307\" target=\"_blank\" rel=\"noopener\">(2023) 4 SCC 209<\/a>]<\/p>\n<\/div>\n<div style=\"background-color: #e6eeff; border-bottom: 1px solid black; border-bottom-style: dashed;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002726935\" target=\"_blank\" rel=\"noopener\">Criminal Procedure Code, 1973<\/a> &#8212; Ss. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519406\" target=\"_blank\" rel=\"noopener\">167(2)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519737\" target=\"_blank\" rel=\"noopener\">437(5)<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001519740\" target=\"_blank\" rel=\"noopener\">439(2)<\/a> r\/w Ch. XXXIII &#8212; Default bail:<\/span> Principles clarified relating to permissibility of cancellation of default bail on merits after submission of charge-sheet. [<i>State<\/i> v. <i>T. Gangi Reddy<\/i>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001458311\" target=\"_blank\" rel=\"noopener\">(2023) 4 SCC 253<\/a>]<\/p>\n<\/div>\n<div style=\"border-bottom: 1px solid black; border-bottom-style: dashed;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002955939\" target=\"_blank\" rel=\"noopener\">Income Tax Act, 1961<\/a> &#8212; Ss. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001559417\" target=\"_blank\" rel=\"noopener\">158-BFA(1)<\/a>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001559413\" target=\"_blank\" rel=\"noopener\">158-BC<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001559414\" target=\"_blank\" rel=\"noopener\">158-BD<\/a> r\/w S. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001559357\" target=\"_blank\" rel=\"noopener\">132<\/a> &#8212; Block Assessment:<\/span> Ch. XIV-B prescribes a special procedure for computation of income for the block period in search and seizure cases. S. 158-BD shall be applicable in case of any person other than a person with respect to whom search was made. Held, Ch. XIV-B is a complete code in itself providing for self contained machinery for assessment of undisclosed income for the block period. Therefore, in case of the person other than searched person the notice under S. 158-BD would be required\/sufficient and in case of late filing of the return under S. 158-BC, interest will be leviable under S. 158-BFA. [<i>Karnavati Veneers (P) Ltd.<\/i> v. <i>New India Assurance Co. Ltd.<\/i>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001458310\" target=\"_blank\" rel=\"noopener\">(2023) 4 SCC 247<\/a>]<\/p>\n<\/div>\n<div style=\"border-bottom: 1px solid black; border-bottom-style: dashed;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002825996\" target=\"_blank\" rel=\"noopener\">Protection of Children from Sexual Offences Act, 2012<\/a> &#8212; Ss. <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550496\" target=\"_blank\" rel=\"noopener\">19<\/a> and <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001550499\" target=\"_blank\" rel=\"noopener\">21<\/a> &#8212; Object:<\/span> Person on coming to know about commission of offence under POCSO Act, held, is obliged to promptly report the same to the specified authorities.
