Gujarat High Court<\/span>: In a criminal revision petition filed by Congress leader Rahul Gandhi, challenging the Surat Sessions Court's order, wherein his plea to stay the conviction order in defamation case was dismissed. The Single Judge Bench of Gita Gopi, J., recused from hearing the appeal.<\/p>\n

Background<\/p>\n

Rahul Gandhi had preferred an application before Surat Sessions Court for stay on conviction judgment and order dated 23-03-2023, wherein, Surat Court had sentenced him to imprisonment of two years in defamation case under Sections 389<\/a> and 389(1)<\/a> of Criminal Procedure Code, 1973<\/a>. The application was dismissed by the Sessions Court.<\/p>\n

Aggrieved by the Sessions Court's order, Rahul Gandhi had filed an appeal before the Court, seeking dismissal of the Sessions Court's conviction order.<\/p>\n

The Court recused itself from hearing the appeal and said, ‘not before this Court'. <\/p>\n
