{"id":286754,"date":"2023-03-12T12:00:58","date_gmt":"2023-03-12T06:30:58","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=286754"},"modified":"2023-03-12T12:45:58","modified_gmt":"2023-03-12T07:15:58","slug":"government-of-tamil-nadu-notified-tamil-nadu-civil-services-appointment-on-compassionate-grounds-rules-legal-update-legal-research-legal-news","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2023\/03\/12\/government-of-tamil-nadu-notified-tamil-nadu-civil-services-appointment-on-compassionate-grounds-rules-legal-update-legal-research-legal-news\/","title":{"rendered":"Tamil Nadu notifies Civil Services (Appointment on Compassionate Grounds) Rules, 2023"},"content":{"rendered":"<p><script type=\"text\/javascript\">\n\u00a0\u00a0\u00a0 document.title = 'Tamil Nadu Compassionate Ground Appointment Rules 2023 | SCC Blog'\n\u00a0\u00a0\u00a0 document.querySelector('meta[name=\"description\"]').setAttribute(\"content\", \"\");<\/script><\/p>\n<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\">On 8-3-2023, the Government of Tamil Nadu notified the Tamil Nadu Civil Services (Appointment on Compassionate Grounds) Rules, 2023.<\/p>\n<p style=\"font-weight: bold;\">Key Points:<\/p>\n<ol style=\"list-style-type: decimal;\">\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\">Under these rules, a <span style=\"font-weight: bold;\">Government Servant<\/span> (&#8216;GS&#39;) means a person who has been appointed to any service\/ post in connection with the affairs of the State and includes a probationer, an approved probationer and a full member of a service.<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\">The<span style=\"font-weight: bold;\"> family members of the following GS will be eligible<\/span> for appointment on compassionate grounds:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\">GS including those who are under suspension who died in harness,<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\">GS, who retired on medical invalidation, with not less than 5 years of left over service and,<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-bottom: 3%;\">Missing Government servants, who were declared to be dead with effect from a date anterior to the date of their superannuation.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\">The<span style=\"font-weight: bold;\"> priority<\/span> <span style=\"font-weight: bold;\">for appointing<\/span> on compassionate grounds will be:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\">Legally wedded spouse<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\">Son\/ Daughter- Legitimate or Adopted<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\">Parents<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-bottom: 3%;\">Brother\/ Sister<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\"><span style=\"font-weight: bold;\">Time limit to make application- <\/span>within 3 years from the date of death\/ retirement on medical invalidation or when the Court orders that the missing GS is declared to be dead.<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\">Appointment will be confined to Group &#8216;C&#39; &amp; Group &#8216;D&#39; posts depending upon the educational qualifications of the applicant.<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\"><span style=\"font-weight: bold;\">Reservation<\/span> provided under Tamil Nadu Government Servants (Conditions of Service) Act, 2016 will <span style=\"font-weight: bold;\">not apply<\/span> to appointments made under these rules.<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\">In Group &#8216;C&#39; the total number of compassionate appointments made in any department cannot exceed 5% of the total sanctioned strength. Whereas there is no such ceiling for Group &#8216;D&#39;.<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\">Each appointing authority will have to regularize the services of the person appointed under these rules within a period of 1 year from the date of his joining service.<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\">The following forms have also been introduced:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\"><span style=\"font-weight: bold;\">Form I-<\/span> Application Form for Appointment on Compassionate Grounds.<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\"><span style=\"font-weight: bold;\">Form II-<\/span> Integrated Certificate for Compassionate Ground Appointment<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-left: 0.0mm;\"><span style=\"font-weight: bold;\">Form III- Part A-<\/span> List of applications for Appointment on Compassionate Grounds to Group-C Posts.<\/p>\n<\/li>\n<li>\n<p class=\"List&nbsp;Paragraph\" style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Form III- Part B- <\/span>List of applications for Appointment on Compassionate Grounds to Group-D Posts.<\/p>\n<\/li>\n<\/ul>\n<\/li>\n<\/ol>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>On 8-3-2023, the Government of Tamil Nadu notified the Tamil Nadu Civil Services (Appointment on Compassionate Grounds) Rules, 2023.
