What is the scope of the same?<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">j) What is the power of the governor to invite a person to form the government and whether the same is amenable to judicial review?<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">k) What is the scope of the powers of Election Commission of India with respect to deterrence of an <i>ex-parte<\/i> split within a party?<\/p>\n<p style=\"margin-bottom: 3%;\">On 17-02-2023, the Supreme Court bench had deferred the preliminary question posed by the Uddhav Thackeray faction to reconsider the verdict of <i>Nabam Rebia and Bamang Felix<\/i> v. <i>Deputy Speaker, Arunachal Pradesh Legislative Assembly<\/i>, <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0000051848\">(2016) 8 SCC 1<\/a> which had <a href=\"https:\/\/www.scconline.com\/blog\/post\/2016\/07\/13\/arunachal-pradeshs-governors-order-of-preponing-the-6th-session-of-the-assembly-by-a-month-quashed\/\">held<\/a> that the Speaker could not initiate disqualification proceedings when a resolution seeking his removal was pending.<\/p>\n<p style=\"margin-bottom: 3%;\">On the question of reference, the coram had <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/02\/17\/sc-constitution-bench-protracted-to-decide-on-issue-of-reference-of-5-judge-bench-nabam-rebia-to-larger-bench-will-decide-along-with-merits-of-case-legal-news-legal-research-updates\/\">stated<\/a> that the matter could not be decided in isolation and divorced from the facts of the case and same needed to be decided along with the merits of the case.<\/p>\n<p style=\"margin-bottom: 3%;\">The matter has been adjourned for hearing on 22-02-2023.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Subhash Desai v.
