When Justice <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/11\/09\/justice-dr-d-y-chandrachud-takes-the-reins-as-the-50th-chief-justice-of-india-know-thy-chief-justice\/\">Dr D.Y. Chandrachud<\/a> took up the mantle of Chief Justice of India, filling up of judicial vacancies featured prominently in his \u201c<a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/11\/15\/not-here-to-do-miracles-but-to-work-on-bringing-institutional-changes-justice-dy-chandrachud-shares-his-to-do-list-as-the-50th-cji\/\">list of objectives<\/a>\u201d, which included not only District and State Judiciary, but also the Supreme Court.<\/p>\n<p style=\"margin-bottom: 3%;\">The preceding year was <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/12\/27\/2-new-cjis-8-retirements-3-appointments-reflecting-upon-a-hectic-2022-for-the-supreme-court-judge-strength\/\">hectic with its monthly retirements<\/a>, and the Supreme Court Collegium toiled to fill the gaps. The recommendations for new Judges were made in <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/12\/14\/sc-collegium-recommends-elevation-of-5-chief-justices-and-judges-to-supreme-court\/\">December 2022<\/a> and <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/02\/01\/supreme-court-recommends-two-more-names-for-appointment-as-sc-judges-against-the-two-remaining-vacancies-legal-research-legal-news-updates\/\">January 2023<\/a>, which fructified in February 2023 with the President approving the appointment of <span style=\"font-weight: bold;\">7 Judges-<\/span><a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/02\/05\/supreme-court-judges-president-assent-legal-updates-knowledge-news-collegium\/\">Justice Pankaj Mithal, Justice Sanjay Karol, Justice P.V. Sanjay Kumar, Justice Ahsanuddin Amanullah, Justice Manoj Misra<\/a>, <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/02\/14\/know-thy-judge-supreme-court-new-appointment-justice-rajesh-bindal-justice-aravind-kumar-legal-news-updates\/\">Justice Rajesh Bindal and Justice Aravind Kumar<\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"color: #171617;\">What is significant is that the inclusion of 7 new appointees, has catapulted the number of Judges in the Supreme Court to 34, which is the sanctioned number of Judges as mandated by<\/span> Section 2 of Supreme Court (Number of Judges) Act, 1956.<\/p>\n<p style=\"margin-bottom: 3%;\">However, it is fascinating to note, that <span style=\"font-weight: bold;\">originally, the sanctioned strength of Supreme Court Judges was not 34!<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-weight: bold;\"><span style=\"color: #c00000;\">Strengthening the Supreme Court- As it Happened<\/span><a id=\"fnref1\" title=\"1. History of the Supreme Court, Supreme Court of India\" href=\"#fn1\"><sup>1<\/sup><\/a><\/span><\/p>\n<p style=\"margin-bottom: 3%;\">The <span style=\"font-weight: bold;\">Constitution, as drafted, envisaged a Supreme Court with 8 Judges<\/span> i.e., 1 Chief Justice and 7 puisne Judges, leaving it to\u00a0 Parliament to increase the number if they felt so. As time passed, the workload of the Judges increased, which prompted Parliament to make necessary amends and increase the number of Judges.<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><span style=\"color: #0000cc;\">Did You Know?<\/span> <i>From 1950 to 2019, Parliament has increased the Supreme Court Judges\u2019 sanctioned strength 6 times!<\/i><\/span><\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">Merely 6 years after the Constitution of India came into effect; Parliament <span style=\"font-weight: bold;\">in 1956<\/span> increased the number of Judges from 8 to 11.<\/p>\n<p style=\"margin-bottom: 3%;\">Then in <span style=\"font-weight: bold;\">1960<\/span>, the Judges\u2019 number were increased to 14.<\/p>\n<p style=\"margin-bottom: 3%;\">Approximately 18 years later, in <span style=\"font-weight: bold;\">1978<\/span>, the sanctioned strength of Supreme Court Judges was again increased to 18.<\/p>\n<p style=\"margin-bottom: 3%;\">In <span style=\"font-weight: bold;\">1986<\/span> the number of Supreme Court Judges was increased to 26 which number carried on until the year <span style=\"font-weight: bold;\">2009<\/span>, when Parliament again increased the sanctioned strength to 31 Judges.<\/p>\n<p style=\"margin-bottom: 3%;\">10 years later, <span style=\"font-weight: bold;\">in 2019<\/span>, the <span style=\"font-weight: bold;\">Supreme Court (Number of Judges) Amendment Bill, 2019<\/span> was introduced in Parliament, which sought to increase the number of Supreme Court Judges. The Bill was passed, and consequently the Supreme Court\u2019s Judges\u2019 sanctioned strength was increased to <span style=\"font-weight: bold;\">34 Judges.<\/span><\/p>\n<p style=\"text-align: center;\"><span style=\"font-weight: bold; color: #c00000;\">Trajectory of Supreme Court Appointments from 2019 till present<\/span><\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\"><span style=\"color: #0000cc;\">Did You Know?<\/span><\/span> <span style=\"font-style: italic;\"><span style=\"font-weight: bold;\">Before February 2023, it was in 2019 [September- November]<a id=\"fnref2\" title=\"2. Supreme Court regains full working strength., The Economic Times\" href=\"#fn2\"><sup>2<\/sup><\/a> that the Supreme Court had achieved its newly sanctioned strength of 34 Judges.<\/span><\/span><\/p>\n<\/li>\n<\/ul>\n<p style=\"text-align: center; margin-bottom: 3%;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2023\/02\/SC-Judge-Numbers-1-300x175.png\" alt=\"\" width=\"300\" height=\"250\" \/><\/p>\n<p style=\"margin-bottom: 3%;\">With the sanctioned strength of the Judges increasing, the appointment of Justices <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/07\/11\/supreme-court-judge-justice-krishna-murari-know-thy-judge-judgments-legal-judiciary-knowledge-updates\/\">Krishna Murari<\/a>, <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/10\/21\/know-thy-judge-justice-s-ravindra-bhat-2\/\">S. Ravindra Bhat<\/a>, <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/06\/30\/know-thy-judge-justice-v-ramasubramanian\/\">V. Ramasubramanian<\/a>, and <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/02\/01\/know-thy-judge-justice-hrishikesh-roy\/\">Hrishikesh Roy<\/a> completed the required number for 2019<a id=\"fnref3\" title=\"3. New Judges Appointed, SC Observer\" href=\"#fn3\"><sup>3<\/sup><\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">However, in 2020, an unprecedented crisis, in the form of Covid-19 pandemic presented itself before the nation and the world. With governments and people dealing with a \u2018<i>new normal<\/i>\u2019, the judiciary also did not remain unaffected. With lockdowns in force, the Supreme Court became immensely focussed on proper disposal of cases, adjusting itself to the wide-spread use of technology. In this pandemonium, there were <span style=\"font-weight: bold;\">no appointments to the Supreme Court in 2020<\/span><a id=\"fnref4\" title=\"4. 63 SC Judges Appointed in the last decade, SC Observer\" href=\"#fn4\"><sup>4<\/sup><\/a>.<\/p>\n<p style=\"margin-bottom: 3%;\">However, <span style=\"font-weight: bold;\">in 2021<\/span>, the <span style=\"color: #171617;\">President appointed<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/08\/26\/president-appoints-9-supreme-court-judges\/\">9 Supreme Court Judges<\/a>, <span style=\"color: #171617;\">including 3 women and a former ASG.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"color: #171617;\">In<\/span> <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/12\/27\/2-new-cjis-8-retirements-3-appointments-reflecting-upon-a-hectic-2022-for-the-supreme-court-judge-strength\/\"><span style=\"font-weight: bold;\">2022<\/span><\/a>, <span style=\"color: #171617;\">however the Supreme Court saw an onslaught of retirements. That year itself, a total 8 Judges, including 2 Chief Justices retired and only 3 new Judges were appointed. By the end of 2022, the retirements and subsequent appointments brought the Judges\u2019 strength to 28 out of 34 Judges.<\/span><\/p>\n<p style=\"text-align: center; margin-bottom: 3%;\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/www.scconline.com\/blog\/wp-content\/uploads\/2023\/02\/SC-Judge-Numbers-2-300x188.png\" alt=\"\" width=\"300\" height=\"250\" \/><\/p>\n<p style=\"text-align: center;\"><span style=\"font-weight: bold; color: #c00000;\">The Gender Gap<\/span><\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold; color: #0000cc;\">Did You Know?<\/span> <span style=\"font-weight: bold; font-style: italic;\">From<\/span> <span style=\"font-weight: bold; font-style: italic;\">1950 to 2023, only 11 women Judges have graced the hallowed halls of the Supreme Court, as against 255 male Judges!<\/span><a id=\"fnref5\" title=\"5. Former Chief Justices and Judges, Supreme Court of India\" href=\"#fn5\"><sup>5<\/sup><\/a><\/p>\n<\/li>\n<\/ul>\n<p><a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/08\/26\/president-appoints-9-supreme-court-judges\/\">Unlike 2021<\/a>, no woman Judge was <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/12\/30\/2022-the-year-of-1263-judgments-3-cjis-and-important-firsts-an-all-inclusive-supreme-court-roundup\/\">elevated\/appointed<\/a> as a Supreme Court Judge in 2022 and with <a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/09\/23\/justice-indira-banerjee-powering-and-empowering-her-way-to-the-top\/\">Justice Indira Banerjee\u2019s retirement<\/a>, Supreme Court is left with only 3 women judges, <a href=\"https:\/\/www.scconline.com\/blog\/post\/2021\/08\/26\/president-appoints-9-supreme-court-judges\/\">who took oath in 2021-<\/a><\/p>\n<ul style=\"list-style-type: disc;\">\n<li><a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/09\/02\/know-thy-judge-justice-hima-kohli-an-advocate-for-womens-rights-and-empowerment\/\">Justice Hima Kohli<\/a>,<\/li>\n<li><a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/10\/30\/justice-bv-nagarathna-igniting-hope-for-the-first-ever-woman-chief-justice-of-india\/\">Justice B.V. Nagarathna<\/a> and<\/li>\n<li>\n<p style=\"margin-bottom: 3%;\"><a href=\"https:\/\/www.scconline.com\/blog\/post\/2022\/06\/10\/know-thy-judge-justice-bela-trivedi-supreme-court-legal-knowledge-limca-record-reserach-update-news\/\">Justice Bela M. Trivedi<\/a>.<\/p>\n<\/li>\n<\/ul>\n<p style=\"text-align: center;\"><span style=\"font-weight: bold; color: #c00000;\">No Rest for the Collegium!<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Now that the vacant seats of the Supreme Court have been filled, there will be peace, as the Court will now function at its full strength\u2026 for now.<\/p>\n<p>This year, 9 Judges are scheduled to retire. <a href=\"https:\/\/www.scconline.com\/blog\/post\/2023\/01\/04\/supreme-court-justice-abdul-nazeer-retires-throwback-to-a-career-of-four-decades-legal-news-updteas-legal-research\/#fn1\">Justice Abdul Nazeer having retired in January<\/a>, the other 8 Judges are due to bid adieu to the Court later this year<a id=\"fnref6\" title=\"6.
