{"id":283895,"date":"2023-02-14T15:00:50","date_gmt":"2023-02-14T09:30:50","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=283895"},"modified":"2023-02-17T12:09:19","modified_gmt":"2023-02-17T06:39:19","slug":"toys-quality-control-order-2020-issued-ensure-that-children-below-14-years-are-not-exposed-to-toys-containing-toxic-material-delhi-high-court-dismisses-frivolous-pil-filed-by-toy-manufacturers-to-avo","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2023\/02\/14\/toys-quality-control-order-2020-issued-ensure-that-children-below-14-years-are-not-exposed-to-toys-containing-toxic-material-delhi-high-court-dismisses-frivolous-pil-filed-by-toy-manufacturers-to-avo\/","title":{"rendered":"Toys (Quality Control) Order, 2020 issued to ensure that children below 14 years are not exposed to toys containing toxic material; Delhi High Court dismisses frivolous PIL filed by toy manufacturers to avoid compliance"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><b>Delhi High Court:<\/b> In a case wherein Public Interest Litigation (PIL) was filed by the toy manufacturers stating that they should be permitted to sell their toys which they had imported from manufacturer before 2021 and the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001083855\">Toys (Quality Control) Order, 2020<\/webaddress> (&#8220;2020 Order&#8221;) should not come their way, a Division Bench of <b>Satish Chandra Sharma, C.J.*<\/b> and Subramonium Prasad, J. dismissed the PIL and held that the present PIL was nothing but a frivolous PIL as the toy manufacturers wanted to avoid compliance with the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001083855\">2020 Order<\/webaddress>. The Court further held that the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001083855\">2020 Order<\/webaddress> had been issued to ensure that the consumers who were children below the age of 14 years were not exposed to sub-standard goods\/goods containing toxic material\/toys containing toxic material.<\/p>\n<p><b>Background<\/b><\/p>\n<p style=\"margin-bottom: 3%;\">The petitioner filed the present petition as a PIL stating that Association members were importing toys manufactured from foreign countries and had imported many toys before 2021. However, on account of a notification dated 25-2-2020, issued by the Ministry of Commerce and Industries, they were not able to sell their toys as by the notification it had been made mandatory that the toys imported by importer should confirm the standard laid down under BIS (Conformity Regulations), 2018 (&#8220;2018 Regulations&#8221;), and the toys so imported should qualify the parameters laid down under the quality control orders which had come into force with effect from 01.09.2020.<\/p>\n<p style=\"margin-bottom: 3%;\">The petitioner prayed that they should be permitted to sell their toys which they had imported from manufacturer before 2021 and the notification dated 25-2-2020 should not come their way. The petitioner also prayed for compensation for stocks imported or manufactured before 2021. The respondents submitted that sub-standard toys were being imported in the country, and there were many Labs available for obtaining desired certificate there.<\/p>\n<p style=\"margin-bottom: 3%;\">It was submitted that the toys which were being imported, were found to be sub-standard toys and Quality Council of India (QCI) submitted a detailed and exhaustive report in respect of toys available in the market. Thereafter, the foreign trade policy for importing toys had been made stringent through the revised notification dated 2-12-2019, and after consultation with stakeholders, a notification was issued on 25-2-2020 and six months&#8217; time was granted to all stakeholders to be prepared with the date of implementation fixed as 1-9-2020.<\/p>\n<p style=\"margin-bottom: 3%;\">The respondents submitted that this action was to promote <b>domestic industry under the Nation Action Plan for toys and to ensure that sub-standard toys were not imported as they contain toxic material.<\/b><\/p>\n<p><b>Analysis, Law, and Decision<\/b><\/p>\n<p style=\"margin-bottom: 3%;\">The Court noted that to ensure that sub-standard toys with toxic substances were not sold in the market, a notification had been issued by the Government of India in exercise of powers conferred under the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002756733\">Bureau of Indian Standards Act, 2016<\/webaddress> (&#8220;BIS Act&#8221;) making it mandatory for the toys manufacturer to obtain a registration certificate under the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002756733\">BIS Act<\/webaddress>, and the <doclink docname=\"2018 Regulations\" actblocktype=\"\" sectionno=\"\" doi=\"\" match=\"no\">2018 Regulations<\/doclink>. The Government of India, keeping in view the fact that large numbers of toys were imported in the country, had granted six months&#8217; time to the industry in the matter of implementation of the notification.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court opined that the documents on record revealed that the impugned notification issued by the Government of India was, in fact, in larger public interest, and the present Writ Petition was not a PIL but personal interest litigation of certain toy manufacturers. Under the garb of PIL, the toy manufacturers wanted to import sub-standard toys in the country, and by no stretch of imagination they could be permitted to violate the norms fixed by the Government of India under the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001083855\">Toys (Quality Control) Order, 2020<\/webaddress> (&#8220;2020 Order&#8221;).<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further noted that the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001083855\">2020 Order<\/webaddress> was published on 25-2-2020 and it came into force w.e.f. 1-9-2020, which means that enough time was granted to all manufacturers\/importers to comply with the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001083855\">2020 Order<\/webaddress>. The Court even failed to understand as to how public interest was involved in the present case, whereas, on the contrary, the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001083855\">2020 Order<\/webaddress> had been issued in public interest as many toys were found to have toxic material, and they were subject to various tests by the Quality Council of India (&#8220;QCI&#8221;).<\/p>\n<p style=\"margin-bottom: 3%;\"><span>The Court relied on <i>Tehseen Poonawalla<\/i> v. <i>Union of India<\/i>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/e732Y4Ig\">(2018) 6 SCC 72<\/a>, wherein the Supreme Court held that <i>&#8220;the misuse of public interest litigation was a serious matter of concern for the judicial process. Both this Court and the High Courts are flooded with litigations and are burdened by arrears. Frivolous or motivated petitions, invoking the public interest detract from the time and attention which courts must devote to genuine causes &#8221;.<\/i> The Court opined that the present PIL was filed at the behest of traders of toys\/manufacturers of toys, who wanted to avoid compliance with the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001083855\">2020 Order<\/webaddress> dated 25-2-2020.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court further opined that the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001083855\">2020 Order<\/webaddress> which was formulated under Sections <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001530623\">16(1)<\/webaddress> and (2) read with Sections <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001530624\">17<\/webaddress> and Section <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001530633\">25(3)<\/webaddress> of the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002756733\">BIS Act<\/webaddress>, <i>prima facie<\/i> conferred power upon the Central Government to issue direction as might be necessary to protect the interest of consumers and various other stakeholders and the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001083855\">2020 Order<\/webaddress> had been issued to ensure that the children below the age of 14 years are not exposed to sub-standard goods\/goods containing toxic material\/toys containing toxic material.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">Therefore, the Court dismissed the petitions and held that the present PIL was nothing but frivolous a PIL. Therefore, the Court did not find any reason to interfere with the <webaddress url=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-9001083855\">2020 Order<\/webaddress>.<\/p>\n<p style=\"margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Forever Toy Traders Association v.
