It hardly needs to be reiterated that our nation hard earned its freedom through a lengthy and painful struggle. However, once that independence was achieved, there were numerous herculean tasks awaiting the leaders of the freedom struggle. 200 years of brutal colonial rule and a hellish life under the British regime had impressed upon the leaders the necessity of being governed by its own citizens and heal the wounds of discord and division sown by the Empire. They realised the need to lay down a framework which will act as a beacon for the Government and the citizens; a document which will lay down the rights and responsibilities of the State and the people alike. Thus, the Constitution of India, came into being.<\/p>\n<p style=\"margin-bottom: 3%;\">After a series of debates and discussions aka the Constituent Assembly Debates, the framers of the Constitution structured the Constitution and made it flexible to address the ever- changing needs of the Indian society and governance. The ideas, visions and aspirations of the Constituent Assembly members, who were also an integral part of the freedom struggle and culminated into a very important part of the Constitution- <span style=\"font-weight: bold;\">The Preamble.<\/span><\/p>\n<p style=\"text-align: center; font-weight: bold; color: #6600ff;\">Genesis of the Preamble<\/p>\n<p>A Preamble technically means an introductory part of a Constitution or statute, explain the objectives of the said law<a id=\"fnref0\" title=\"1. Preamble, Merriam Webster Dictionary.\" href=\"#fn0\"><sup>1<\/sup><\/a>. The Preamble to the Constitution of India reads thusly:<\/p>\n<p class=\"j2\" style=\"margin-left: 18pt; color: #c00000;\"><span style=\"font-weight: bold;\"><span style=\"font-variant: small-caps;\">We, the people of India<\/span>,<\/span> having solemnly resolved to constitute India into a <span style=\"font-weight: bold;\">[<span style=\"font-variant: small-caps;\">sovereign socialist secular democratic republic<\/span>]<\/span> and to secure to all its citizens:<\/p>\n<p class=\"j2\" style=\"margin-left: 18pt; color: #c00000;\"><span style=\"font-weight: bold; font-variant: small-caps;\">Justice<\/span>\u00a0social, economic and political;<\/p>\n<p class=\"j2\" style=\"margin-left: 18pt; color: #c00000;\"><span style=\"font-weight: bold;\"><span style=\"font-variant: small-caps;\">Liberty<\/span>\u00a0<\/span>of thought, expression, belief, faith and worship;<\/p>\n<p class=\"j2\" style=\"margin-left: 18pt; color: #c00000;\"><span style=\"font-weight: bold;\"><span style=\"font-variant: small-caps;\">Equality<\/span>\u00a0<\/span>of status and of opportunity;<\/p>\n<p class=\"j2\" style=\"margin-left: 18pt; color: #c00000;\">and to promote among them all<\/p>\n<p class=\"j2\" style=\"margin-left: 18pt; color: #c00000;\"><span style=\"font-weight: bold; font-variant: small-caps;\">Fraternity<\/span>\u00a0assuring the dignity of the individual and the\u00a0[unity and integrity of the Nation];<\/p>\n<p class=\"j2\" style=\"margin-left: 18pt; margin-bottom: 3%; color: #c00000;\"><span style=\"font-variant: small-caps;\">In our Constituent Assembly<\/span>\u00a0this twenty-sixth day of November, 1949, do\u00a0<span style=\"font-variant: small-caps;\">hereby adopt, enact and give to ourselves this Constitution<\/span>.<\/p>\n<p style=\"margin-bottom: 3%;\">It is clear from the solemn words above as to what was the aim of the supreme law of the land \u2014 that is our Constitution; and like law itself, the Preamble is also ripe with history. These precise words of the Preamble were result of many a deliberation by the members of the Constituent Assembly, who discussed and debated as to the words that should best describe the objective of the Constitution they are about to draft.<\/p>\n<p>The foundations of the Preamble&#8217;s genesis were laid on 13-12-1946 in the Constitution Hall, New Delhi, wherein under the Chairmanship of Dr Rajendra Prasad, an Objective Resolution regarding <a href=\"http:\/\/www.scconline.com\/DocumentLink\/n0DCLMj1\">\u201cAims and Objects\u201d<\/a> was moved by Pandit Jawaharlal Nehru<a id=\"fnref1\" title=\"2. Constituent Assembly Debates, Vol. 1, 13th December 1946.\" href=\"#fn1\"><sup>2<\/sup><\/a>.<\/p>\n<p style=\"margin-left: 36pt; margin-bottom: 3%;\"><span style=\"color: #0000ff;\">\u201cWe have been cutting our way and clearing the ground on which we intend to erect the edifice of a Constitution. It, however, seems proper that before we proceed further, we should clearly understand where we are going and what we intend building. It is apparent that on such occasions details are unnecessary (\u2026) The Resolution that I am placing before you defines our aims, describes an outline of the plan and points the way which we are going to tread.\u201d<\/span><span style=\"font-weight: bold; font-style: italic; color: #538135;\">\u00a0<\/span><\/p>\n<p>In Pandit Nehru&#8217;s words lay the very first form of the Preamble as it stands today:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">Resolve to proclaim <span style=\"font-weight: bold;\">India as an Independent Sovereign Republic<\/span> and to draw up for her future governance a Constitution.<\/p>\n<\/li>\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">Territories that now comprise British India, the Indian States, and such other parts of India as are outside British India and the States as such other territories as are willing to be constituted into <span style=\"font-weight: bold;\">the Independent<\/span> <span style=\"font-weight: bold;\">Sovereign India, shall be a Union of them all. <\/span><\/p>\n<\/li>\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\"><span style=\"font-weight: bold;\">All power and authority of the Sovereign<\/span> <span style=\"font-weight: bold;\">Independent<\/span> India, its constituent parts and organs of government, are <span style=\"font-weight: bold;\">derived from the People. <\/span><\/p>\n<\/li>\n<li>\n<p class=\"j1\" style=\"margin-bottom: 2.65mm; margin-top: 1.32mm;\"><span style=\"font-weight: bold;\">Adequate safeguards <\/span>shall be provided for minorities, backward and tribal areas, depressed and other backward classes; and<\/p>\n<\/li>\n<li>\n<p class=\"j1\" style=\"margin-bottom: 3%;\">Maintaining the integrity of the territory of the Republic and its sovereign rights on land, sea, and air according to justice and the law of civilised nations.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">The Objective Resolution also made references to the French Revolution and the Oath of the Tennis Court (France), American Revolution and Russian Revolution and their consequent Constitutions, from where it was urged that inspiration may be drawn.<\/p>\n<p>The Objective Resolution so introduced, was further debated, with eminent members like Dr B.R. Ambedkar, M.R. Jayakar, M.R. Masani, F.R. Anthony, Syama Prasad Mookherjee, B. Pattabhi Sitaramayya, Sardar Vallabhbhai Patel, Dr Suresh Chandra Banerjee, Govind Ballabh Pant, etc., participating and contributing with their views-<\/p>\n<p style=\"margin-left: 36pt;\"><span style=\"color: #0000ff;\"><span style=\"font-weight: bold;\">Dr B.R. Ambedkar<\/span>: <\/span>\u201cI am quite convinced that given time and circumstances nothing in the world will prevent this country from becoming one. With all our castes and creeds, I have not the slightest hesitation that we shall in some form be a united people.\u201d<\/p>\n<p style=\"margin-left: 36pt; margin-bottom: 3%;\"><span style=\"color: #0000ff;\"><span style=\"font-weight: bold;\">M.R. Masani<\/span>: <\/span>\u201cI approach this part of the resolution, Sir, as a democratic socialist, a socialist who feels that democracy needs to be extended from the political to the economic and social spheres and that, if socialism does not mean that, then it spite of the fact that neither the word \u2018democracy&#8217; nor the word \u2018Socialist&#8217; finds a place in its Preamble\u201d<span style=\"font-weight: bold;\">.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">In January 1947, the consensus among the members vis-\u00e0-vis the aforestated objective resolution was visible. On 22-1-1947, the resolution of 13-12-1946 was adopted and passed<a id=\"fnref2\" title=\"3. Constituent Assembly Debates, Vol. 2, 22nd January 1947. \" href=\"#fn2\"><sup>3<\/sup><\/a> and this objective resolution thus became<a id=\"fnref3\" title=\"4. Constituent Assembly Debates, Vol. 11, 26th November 1949.\" href=\"#fn3\"><sup>4<\/sup><\/a> the Preamble to the Constitution.<\/p>\n<p>In <i>Kesavananda Bharati<\/i> v.<i> State of Kerala<\/i><a id=\"fnref4\" title=\"5. (1973) 4 SCC 225.\" href=\"#fn4\"><sup>5<\/sup><\/a>, the Supreme Court stated in clear words that, \u201cthe history of the drafting and the ultimate adoption of the Preamble shows<a id=\"fnref5\" title=\"6. Shelat and Grover, JJ., in Kesavananda Bharati v. State of Kerala, (1973) 4 SCC 225 (para 513).\" href=\"#fn5\"><sup>6<\/sup><\/a>:<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(1) That it did not &#8216;walk before the Constitution&#8217; as is said about the Preamble to the United States Constitution.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(2) That it was adopted last as a part of the Constitution.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(3) That the principles embodied in it were taken mainly from the objective resolution.<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt;\">(4) The Drafting Committee felt, it should incorporate in it &#8216;the essential features of the new State.&#8217;<\/p>\n<p style=\"margin-left: 36pt; text-indent: -18pt; margin-bottom: 3%;\">(5) That it embodied the fundamental concept of sovereignty being in the people.\u201d<\/p>\n<p style=\"text-align: center; font-weight: bold; color: #008000;\">Wise words<\/p>\n<p>A thorough reading the Constituent Assembly Debates reveal that the members had debated at length over the words of the Preamble. The Constituent Assembly on 17-10-1949<a id=\"fnref6\" title=\"7. Constituent Assembly Debates, Vol. 10, 17th October 1949. &lt;http:\/\/www.scconline.com\/DocumentLink\/Rzq4ziNc&gt;.\" href=\"#fn6\"><sup>7<\/sup><\/a>, debated heavily upon the words that are to be used to draft the Preamble. The debated words included:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">\u201cWe the people of India.\u201d<\/p>\n<\/li>\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-bottom: 3%;\">\u201cSovereign democratic republic\u201d or \u201csovereign federal republic\u201d of \u201csovereign independent republic.\u201d<\/p>\n<\/li>\n<\/ul>\n<p>The Objective Resolution of 1946 contained a &#8220;firm and solemn resolve&#8221; to have a sovereign Indian Republic. Pandit Jawaharlal Nehru stated that:<\/p>\n<p style=\"margin-left: 36pt; margin-bottom: 3%;\">\u201cWe have not mentioned the word \u2018republic&#8217; till this time; but you will well understand that a free India can be nothing but a republic (\u2026) The House will notice that in this resolution, although we have not used the word \u2018democratic&#8217; because we thought it is obvious that the word \u2018republic&#8217; contains that word.\u201d<\/p>\n<p>As time passed and the Constitution drafting process began to reach its final stages, a consensus was established upon the words \u201csovereign democratic republic\u201d.<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-bottom: 3%; text-align: center; color: #c00000;\"><span style=\"font-weight: bold;\">Did you Know? <\/span>During the course of finalising the Preamble, motions to include the words \u201cIn the name of God\u201d and inclusion of Mahatma Gandhi&#8217;s name in its opening sentence of the Preamble were introduced, but the same was negatived<a id=\"fnref7\" title=\"8. Shelat and Grover, JJ., in Kesavananda Bharati v. State of Kerala, (1973) 4 SCC 225 (para 513).\" href=\"#fn7\"><sup>8<\/sup><\/a>.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">So far, the word \u201csecular\u201d was missing during the early discussions on the Preamble, however, in this debate, Brajeshwar Prasad moved the motion to amendment and include the words: &#8220;secular, cooperative commonwealth to establish socialist order\u201d. Brajeshwar Prasad also wanted to include \u201cadequate means of livelihood\u201d; \u201cfree medical aid\u201d; \u201cfree and compulsory education\u201d and \u201cfree military training\u201d in his version of the Preamble as well. The motion was however, negatived as well.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Liberty Equality Fraternity- <\/span>The Objective Resolution presented by Pandit Nehru had urged the members to seek inspiration from the French Revolution and a glimpse of that is reflected in the use of the words \u201clibert\u00e9, egalit\u00e9, fraternit\u00e9\u201d, which was the slogan<a id=\"fnref8\" title=\"9. French Revolution.\" href=\"#fn8\"><sup>9<\/sup><\/a> of the French Revolution. Inclusion of these words were discussed in detail throughout the debates<a id=\"fnref9\" title=\"10. Constituent Assembly Debates, Vol. 11, 19th November 1949 &lt;http:\/\/www.scconline.com\/DocumentLink\/kJ5h8K99&gt;; Constituent Assembly Debates, Vol. 11, 23rd November 1949 &lt;http:\/\/www.scconline.com\/DocumentLink\/6Yldwa5t&gt;.\" href=\"#fn9\"><sup>10<\/sup><\/a> and it eventually found its place in the Preamble.<\/p>\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Socialist<\/span>: Pandit Nehru, while introducing the Objective Resolution in 1946, raised the idea of India being a socialist State, however, he stated that, \u201cWell, I stand for socialism and, I hope, India will stand for socialism and that India will go towards the Constitution of a socialist State (\u2026) but the main thing is that in such a resolution, if in accordance with my own desire, I had put in, that we want a socialist State, we would have put in something which may be agreeable to many and may not be agreeable to some and we wanted this resolution not to be controversial in regard to such matters.\u201d<\/p>\n<p style=\"margin-bottom: 3%;\">Maulana Hasrat Mohani in 1949, moved a motion that the Preamble should begin &#8220;We, the People of India, having solemnly resolved to constitute India into a Union of Indian Socialistic Republics (UISR).\u201d However, the motion was negatived by the members.<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-bottom: 3%; color: #c00000;\"><span style=\"font-weight: bold;\">Did you Know? <\/span>The aforestated name of the Indian Republic was fashioned along the lines of the USSR<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%; text-align: center; font-weight: bold; color: #6600ff;\">Amendment to the Preamble<\/p>\n<p style=\"margin-bottom: 3%;\">Ever since the Constitution was adopted and came into effect, it has been subjected to various amendments (as it was envisioned by the framers given the fact that laws must change according to the needs of the society), however, the Preamble so far had been left unamended. The trajectory of the Preamble&#8217;s amendment and its role and place in the Indian Constitution is a connected history involving a tug of war between the legislature and judiciary (and has given sleepless nights to any student of law).<\/p>\n<p style=\"margin-bottom: 3%;\">The only time when the Preamble was amended, was in 1976, when the Indira Gandhi Government amended the Constitution via <a href=\"http:\/\/www.scconline.com\/DocumentLink\/Rr0FCQeM\">Constitution (42nd Amendment) Act, 1976<\/a>, thereby rendering the Preamble its present form<span style=\"font-weight: bold;\">.<\/span><\/p>\n<p>This amendment brought in two changes:<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm;\">As it was stated earlier that during the Constituent Assembly Debates, the framers of the Constitution refrained from introducing the words \u201csocialist\u201d and \u201csecular\u201d in the Preamble. The 42nd Amendment altered it, and Section 2 of the Amendment Act introduced these words.<\/p>\n<p class=\"List\u00a0Paragraph\" style=\"margin-left: 0.0mm; font-weight: bold; color: #008000;\">\n<\/li>\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-bottom: 3%;\">Secondly, Section 2 also substituted \u201cunity of the nation\u201d with \u201cunity and integrity of the nation\u201d.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">The timeline of <i>Kesavananda Bharati<\/i><a id=\"fnref10\" title=\"11. (1973) 4 SCC 225.\" href=\"#fn10\"><sup>11<\/sup><\/a> verdict and this Amendment seems baffling, however, the Supreme Court in <i>S.R. Bommai<\/i> v.<i> Union of India<\/i><a id=\"fnref11\" title=\"12. (1994) 3 SCC 1.\" href=\"#fn11\"><sup>12<\/sup><\/a>, stated that even though the word \u201csecular\u201d was introduced in 1976, the concept of secularism was very much embedded in the Constitutional philosophy.<\/p>\n<p style=\"text-align: center; font-weight: bold; color: #6600ff;\">Preamble and the Supreme Court<\/p>\n<p style=\"text-align: center; font-weight: bold; color: #008000;\">The Identity Battle- Whether a Part or a Basic Structure of the Constitution?<\/p>\n<p style=\"margin-bottom: 3%;\">The Constitution authorised the Supreme Court of India as the highest authority regarding interpretation of its provisions. It was only a matter of time that the importance and interpretation of Preamble came up before the Supreme Court.<\/p>\n<p style=\"margin-bottom: 3%;\">The Supreme Court of India deliberated over several questions surrounding the Preamble. One such early case was <i>Berubari Union (I), In re<\/i><a id=\"fnref12\" title=\"13. AIR 1960 SC 845.\" href=\"#fn12\"><sup>13<\/sup><\/a>, where 8-Judge Bench of the Court deliberated over this presidential reference. The Judges while noting a contention by N.C. Chatterjee stating that Parliament has no power to cede any part of the territory of India in favour of a foreign State either by ordinary legislation or even by the amendment of the Constitution as the Preamble clearly postulates that like the democratic republican form of Government the entire territory of India is beyond the reach of Parliament and cannot be affected either by ordinary legislation or even by constitutional amendment; opined that: \u201cThere is no doubt that the declaration made by the people of India in exercise of their sovereign will in the Preamble to the Constitution is, in the words of story, &#8216;a key to open the mind of the makers&#8217; which may show the general purposes for which they made the several provisions in the Constitution; but nevertheless, the Preamble is not a part of the Constitution<span style=\"font-weight: bold;\">.<\/span>&#8220;<\/p>\n<ul style=\"list-style-type: disc;\">\n<li>\n<p class=\"List\u00a0Paragraph\" style=\"margin-bottom: 3%; text-align: center; font-weight: bold; color: #6600ff;\">Did you Know? The Constituent Assembly while debating on 17-10-1949, adopted the motion to add the Preamble as a part of the Constitution.<\/p>\n<\/li>\n<\/ul>\n<p style=\"margin-bottom: 3%;\">The basic structure issue spawned many lengthy cases and mostly revolved around the fundamental rights and the Parliament&#8217;s amending power under Article 368 of the Constitution. All those deliberations culminated in the historic case of <i>Kesavananda Bharati<\/i> v.<i> State of Kerala<\/i><a id=\"fnref13\" title=\"14. (1973) 4 SCC 225.\" href=\"#fn13\"><sup>14<\/sup><\/a>, where 13 Supreme Court Judges gave detailed opinions over several aspects of including the basic structure doctrine; which parts of the Constitution fall under the scheme of basic structure and Parliament&#8217;s power to amend those parts. It was held that the Parliament cannot amend the features that basic or essential to the Constitution.<\/p>\n<p style=\"margin-bottom: 3%;\">One of the significant portions of the verdict was dedicated the Preamble. It was clarified that the Preamble was indeed an important part of the Constitution.<\/p>\n<p style=\"margin-bottom: 3%;\">The Judges relying on the Constituent Assembly Debates, stated that, all importance has to be attached to the Preamble of a constitutional statute. He further stated that <i>Berubari Union (I), In re<\/i><a id=\"fnref14\" title=\"15. AIR 1960 SC 845.\" href=\"#fn14\"><sup>15<\/sup><\/a><span style=\"font-style: italic;\">, <\/span>was wrong in holding that Preamble is not a part of the Constitution. It was stated that Preamble embodies the \u201cfundamentals\u201d underlying the structure of the Constitution<span style=\"font-weight: bold;\">.<\/span><\/p>\n<p style=\"margin-bottom: 3%;\">It was stated that \u201cPreamble is unamendable, and it cannot be varied altered or repealed\u201d<a id=\"fnref15\" title=\"16. Shelat and Grover, JJ., in para 521.\" href=\"#fn15\"><sup>16<\/sup><\/a> and that the \u201cPreamble is a part of the Constitution and relates to the basic structure or framework of the Constitution\u201d.<a id=\"fnref16\" title=\"17. Khanna, J., in para 1421.\" href=\"#fn16\"><sup>17<\/sup><\/a><\/p>\n<p style=\"text-align: center; font-weight: bold; color: #008000;\">Preamble as the aid<\/p>\n<p style=\"margin-bottom: 3%;\">As stated earlier, the Preamble was laid down in order guide the nation towards a better and secure future, it was no wonder that the Supreme Court time and again took inspiration from the principles stated in the Preamble in order to interpret the Constitution.<\/p>\n<p style=\"margin-bottom: 3%;\">For instance, right to life as enshrined in Article 21, went through various stages of development and evolution. Recently, <i>K.S. Puttaswamy<\/i> v.<i> Union of India<\/i><a id=\"fnref17\" title=\"18. (2017) 10 SCC 1.\" href=\"#fn17\"><sup>18<\/sup><\/a>, the Supreme Court was aided by the Preamble to include right to privacy as part of Article 21 of the Constitution.<\/p>\n<p style=\"margin-bottom: 3%;\">Guided by the principles of equality and fraternity, the Supreme Court in <i>Indra Sawhney<\/i> v.<i> Union of India<\/i><a id=\"fnref18\" title=\"19. 1992 Supp (3) SCC 217.\" href=\"#fn18\"><sup>19<\/sup><\/a>, where the Court stated that inequality ill-favours fraternity and there can be no unity without fraternity. Therefore, other objectives of Preamble cannot be realised without affirmative action to reduce inequality.<\/p>\n<p style=\"margin-bottom: 3%;\">The idea of fraternity in the Preamble was invoked by the Supreme Court in <i>Navtej Singh Johar<\/i> v.<i> Union of India<\/i><a id=\"fnref19\" title=\"20.
