{"id":281589,"date":"2023-01-13T15:30:05","date_gmt":"2023-01-13T10:00:05","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=281589"},"modified":"2023-01-24T18:30:01","modified_gmt":"2023-01-24T13:00:01","slug":"allahabad-high-court-issues-bailable-warrant-against-sanjay-prasad-up-principal-secretary-for-contempt-of-court-legal-research-legal-news-updates","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2023\/01\/13\/allahabad-high-court-issues-bailable-warrant-against-sanjay-prasad-up-principal-secretary-for-contempt-of-court-legal-research-legal-news-updates\/","title":{"rendered":"Allahabad High Court issues bailable warrant against Sanjay Prasad, UP Principal Secretary for Contempt of Court"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"margin-bottom: 3%;\"><span style=\"font-weight: bold;\">Allahabad High Court<\/span>: In a second contempt application filed against Sanjay Prasad, Principal Secretary (Home), Government of U.P. due to willful and deliberate disobedience of the writ Court&#8217;s order that directed him to decide the claim of the petitioner for grant of additional increment within a period of three months after treating training period for the purposes of grant of such benefit, Piyush Agrawal, J. issued bailable warrants against Sanjay Prasad, and said that the way the officers of the State are behaving is a very sorry state of affairs and directed this order to be placed before the Law Minister of the State for intimation and necessary action at his end.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court said that the conduct of Sanjay Prasad shows deliberate and willful disobedience of the orders passed by the Writ Court as well as this Court. He has no regard to the orders passed by this Court. For the slackness on their part, the applicant is being put to suffer. Despite filing of the second contempt application, Sanjay Prasad is sitting tight over the matter. Thus, a prima facie case for contempt was made out against him and the other opposite party.<\/p>\n<p style=\"margin-bottom: 3%;\">The Court issued bailable warrants against Sanjay Prasad and directed him to appear in person on the date fixed for framing of charges for willful and deliberate disobedience of the order passed by the writ Court.<\/p>\n<p style=\"margin-bottom: 3%;\">Further, the Court directed the Director General of Police to serve the bailable warrants to Sanjay Prasad and to ensure his presence on the next date fixed in the matter.<\/p>\n<p style=\"margin-bottom: 3%;\">The matter will next be taken up on 25-01-2023.<\/p>\n<p style=\"text-indent: 18pt; margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Suresh Chand Rajvanshi v.
