Gavai and B.V. Nagarathna, JJ. has said that the conduct of all the appellants is satisfactory, thus, directed that all the appellants be deemed\u00a0\u00a0 to\u00a0\u00a0 have\u00a0\u00a0 served\u00a0\u00a0 their\u00a0\u00a0 respective\u00a0\u00a0 sentences and to be set at liberty.<\/p>\n<p style=\"text-align: justify;\">In the case at hand, the appellants have been convicted for offences under the Penal Code, 1860, the Arms Act, 1951, the Explosive Substances Act, 1908, the Passport Act, 1967, the Foreigners Act, 1946, the Indian Wireless Telegraphy Act, 1933\u00a0\u00a0 and\u00a0\u00a0 the\u00a0\u00a0 Terrorist\u00a0\u00a0 and Disruptive Activities (Prevention) Act, 1987 for the assassination of the former Prime Minister of India -Rajiv Gandhi, and others on 21-05-1991.<\/p>\n<p style=\"text-align: justify;\">The Court noted that out of the six, the death sentence was confirmed in the case of appellants S. Nalini,\u00a0 Suthendraraja\u00a0 and Sriharan, which was subsequently converted to life imprisonment on account of inordinate delay in deciding their mercy petition, and the\u00a0\u00a0 rest\u00a0\u00a0 of\u00a0\u00a0 the\u00a0\u00a0 appellants were convicted\u00a0\u00a0 and\u00a0\u00a0 sentenced\u00a0\u00a0 to\u00a0\u00a0 life imprisonment.<\/p>\n<p style=\"text-align: justify;\">Further, on 09-09-2018, the State Cabinet passed a resolution recommending the release of all the appellants including\u00a0\u00a0 the\u00a0\u00a0 original\u00a0\u00a0 convict\u00a0\u00a0 A.G. Perarivalan.<\/p>\n<p style=\"text-align: justify;\">The Court relied on <em>A.G. Perarivalan v. State<\/em>, <a href=\"http:\/\/www.scconline.com\/DocumentLink\/903uHCIz\">2022 SCC OnLine SC 635<\/a>, where the Court while dealing with the issue that whether the Governor was bound by the decision of the State Cabinet, or he could refer the matter to the Union of India for its opinion, has held that <strong>\u201cGovernor, in the matter of remission of an appellant convicted under Section 302, was bound by the advice of the State Cabinet\u201d <\/strong>and observed that indisputably, in the present case also, the State Cabinet\u00a0\u00a0 had\u00a0\u00a0 resolved\u00a0\u00a0 to\u00a0\u00a0 grant\u00a0\u00a0 remission\u00a0\u00a0 to all\u00a0\u00a0 the appellants.<\/p>\n<p style=\"text-align: justify;\">The Court examined\u00a0\u00a0 the\u00a0\u00a0 case\u00a0\u00a0 of\u00a0\u00a0 each\u00a0\u00a0 of\u00a0\u00a0 the appellants in light of A.G. Perarivalan (supra) and said that the conduct of all the appellants was satisfactory, as some of them during the period of incarceration, have obtained degrees, did charity work and some were also suffering from various ailments. Further, the Court said that S.\u00a0\u00a0 Nalini,\u00a0\u00a0\u00a0 is\u00a0\u00a0 a woman and has been incarcerated for a period of more than three decades and her conduct has also been found to be satisfactory.<\/p>\n<p style=\"text-align: justify;\">Thus, the Court directed that all the appellants be deemed\u00a0\u00a0 to\u00a0\u00a0 have\u00a0\u00a0 served\u00a0\u00a0 their\u00a0\u00a0 respective\u00a0\u00a0 sentences and to\u00a0\u00a0 be\u00a0\u00a0 set at liberty.<\/p>\n<p style=\"text-align: justify;\"><strong>[<\/strong>R.P.
