{"id":276624,"date":"2022-11-04T10:00:34","date_gmt":"2022-11-04T04:30:34","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=276624"},"modified":"2022-11-04T10:00:34","modified_gmt":"2022-11-04T04:30:34","slug":"police-station-not-a-prohibited-place-under-official-secrets-act-hence-video-recording-inside-police-station-not-an-offence-under-act-bombay-high-court-quashes-fir","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/11\/04\/police-station-not-a-prohibited-place-under-official-secrets-act-hence-video-recording-inside-police-station-not-an-offence-under-act-bombay-high-court-quashes-fir\/","title":{"rendered":"Police station not a \u2018prohibited place\u2019 under Official Secrets Act hence, video recording inside police station not an offence under Act; Bombay High Court quashes FIR"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"text-indent: 18pt;\">&#160; &#160;<\/p>\n<p style=\"text-indent: 18pt; margin-bottom: 3%;\"><b>Bombay High Court<\/b>: In the present case wherein, an FIR was registered by the complainant that during certain proceedings being undertaken in the Police Station, the applicant secretly video recorded the proceedings on his mobile, thereby committing an offence punishable under section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001537970\">3<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002823104\">Official Secrets Act, 1923<\/a>, a Division Bench of Manish Pitale and Valmiki SA Menezes, JJ., held that none of the ingredients of the alleged offence are made out against the applicant.<\/p>\n<p style=\"text-indent: 18pt; margin-bottom: 3%;\">Section 3 of the Official Secrets Act provides penalties for spying and states that a person will face penalty for spying if he commits an act as specified in sub-section (1) thereof.<\/p>\n<p style=\"text-indent: 18pt; margin-bottom: 3%;\">The Court noted that the definition of &#8216;prohibited place&#8217; as defined in section 2(8) of the Official Secrets is exhaustive in nature, which does not specifically include Police Station as one of the places or establishments, which could be included in the definition &#8216;prohibited place&#8217;.<\/p>\n<p style=\"text-indent: 18pt; margin-bottom: 3%;\">Thus, the Court held that secretly video recording the proceedings inside the police station is not an offence under section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001537970\">3<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002823104\">Official Secrets Act, 1923<\/a>.<\/p>\n<p style=\"text-indent: 18pt; margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Ravindra Shitalrao Upadyay v.
