{"id":276379,"date":"2022-10-31T14:00:23","date_gmt":"2022-10-31T08:30:23","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=276379"},"modified":"2022-10-31T14:00:23","modified_gmt":"2022-10-31T08:30:23","slug":"right-to-information-rti-third-party-cpio-nios-consent-legal-updates-legal-news-research","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/10\/31\/right-to-information-rti-third-party-cpio-nios-consent-legal-updates-legal-news-research\/","title":{"rendered":"Central Information Commission| No information of the third parties can be sought via the RTI Act without their consent"},"content":{"rendered":"<div style=\"text-align: justify; line-height: 150%;\">\n<p style=\"text-indent: 18pt;\">\n<p style=\"text-indent: 18pt; margin-bottom: 3%;\"><b>Central Information Commission<\/b>: In a second appeal filed by the appellant under Section <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0001541425\">19<\/a> of the <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002760680\">Right to Information Act, 2005<\/a> on the ground of arbitrary denial of information by the Chief Public Information Officer (CPIO), the Chief Information Officer has held the information sought by the appellant was rightly denied by the CPIO as it pertains to the third party who expressed their dissent from divulging the same to any other third party.<\/p>\n<p style=\"text-indent: 18pt; margin-bottom: 3%;\">The appellant has sought a copy of the application and complete set of documents submitted by Snehkul Public School, Namkun, Ranchi and Sarla Birla Public School, Namkun Ranchi <span class=\"TrackChangeTextInsertion TrackedChange TrackChangeHoverSelectColorPurple SCXW63176600 BCX9\"><span class=\"TextRun SCXW63176600 BCX9\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun TrackChangeHoverSelectHighlightPurple SCXW63176600 BCX9\">at the<\/span><\/span><\/span><span class=\"TrackChangeTextInsertion TrackedChange TrackChangeHoverSelectColorPurple SCXW63176600 BCX9\"><span class=\"TextRun SCXW63176600 BCX9\" lang=\"EN-US\" xml:lang=\"EN-US\" data-contrast=\"auto\"><span class=\"NormalTextRun TrackChangeHoverSelectHighlightPurple SCXW63176600 BCX9\"> time of NOIS OBE accreditation<\/span><\/span><\/span>. The Commission noted that after being dissatisfied with the arbitrary denial of information from the respondent, the appellant filed for a second appeal. The appellant sought the Commission to direct the respondent to provide for complete information.<\/p>\n<p style=\"text-indent: 18pt; margin-bottom: 3%;\">The Commission observed that the CPIO, National Institute of Open Schooling (\u2018NIOS\u2019) denied disclosure of information stating that the named institutions affiliated to NIOS are third parties and refused to consent to the disclosure. Therefore, the Research Centre, Ranchi could not provide the desired documents. Further, the appellant runs study centers in the same region; therefore, furnishing information pertaining to other study centers would hamper competitive positions.<\/p>\n<p style=\"text-indent: 18pt; margin-bottom: 3%;\">The Commission observed that the information sought by the appellant was rightly denied by the CPIO, thus, it found noscope of intervention in the case and therefore, the appeal was disposed of.<\/p>\n<p style=\"text-indent: 18pt; margin-bottom: 3%;\">[<span style=\"font-weight: bold; color: #632423;\">Prakash Sahu v.
