style=\"text-align: justify;\">On 08-08-2022, the Central Board of Indirect Taxes and Customs has published the Passenger Name Record Information Regulations, 2022 which deals with collection of data of international passenger from aircraft operators for risk analysis for the purpose of prevention, detection, investigation and prosecution of offences.<\/p>\n<p style=\"text-align: justify;\">Key points:<\/p>\n<ol>\n<li style=\"text-align: justify;\"><span id=\"page12R_mcid25\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">National Customs Targeting Centre-Passenger <\/span><span dir=\"ltr\" role=\"presentation\">established by the Board to receive and process passenger name record information along with any other <\/span><span dir=\"ltr\" role=\"presentation\">information relevant for risk analysis of passengers.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page14R_mcid1\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Every aircraft operator must register with the proper officer in the <\/span><span dir=\"ltr\" role=\"presentation\">FORM as per<\/span> <span dir=\"ltr\" role=\"presentation\">Annexure-I<\/span> <span dir=\"ltr\" role=\"presentation\">to these regulations.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page14R_mcid2\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Every aircraft operator must transfer the <\/span><span dir=\"ltr\" role=\"presentation\">passenger name record information, <\/span><span dir=\"ltr\" role=\"presentation\">to these regulations<\/span><span dir=\"ltr\" role=\"presentation\">,<\/span> <span dir=\"ltr\" role=\"presentation\">of passengers they <\/span><span dir=\"ltr\" role=\"presentation\">have already collected such information in the normal course of business operations, to the designated <\/span><span dir=\"ltr\" role=\"presentation\">Customs systems by push method using PNRGOV EDIFACT message format.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page14R_mcid10\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Every aircraft operator or its authorised agent who <\/span><span dir=\"ltr\" role=\"presentation\">becomes aware, before or at the time of departure, that any information provided by them under these <\/span><span dir=\"ltr\" role=\"presentation\">regulations is incomplete or inaccurate, must immediately provide such complete or accurate information.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page14R_mcid11\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Passenger name record information received by <\/span><span dir=\"ltr\" role=\"presentation\">Customs designated system must be subject to the strict information privacy and protection in accordance <\/span><span dir=\"ltr\" role=\"presentation\">with the provisions of any law for the time being in force.<\/span><\/span><\/li>\n<li style=\"text-align: justify;\"><span id=\"page14R_mcid14\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Passenger name record information received in Customs <\/span><span dir=\"ltr\" role=\"presentation\">designated system must be retained for a maximum period of five years from the date of such receipt: <\/span><\/span><span id=\"page14R_mcid15\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Provided that the provisions under this sub-regulation shall not be applicable, if such information is <\/span><span dir=\"ltr\" role=\"presentation\">required in the course of an investigation, prosecution, or any court proceeding.<\/span><\/span><\/li>\n<li><span id=\"page17R_mcid5\" class=\"markedContent\"><span dir=\"ltr\" role=\"presentation\">Principal <\/span><span dir=\"ltr\" role=\"presentation\">Additional Director General or Additional Director General of the National Customs Targeting Centre-<\/span><br role=\"presentation\" \/><span dir=\"ltr\" role=\"presentation\">Passenger, may impose a penalty which shall not be less than twenty five thousand rupees but not more <\/span><span dir=\"ltr\" role=\"presentation\">fifty thousand rupees, for each act of non-compliance, on an aircraft operator or his authorised agent who <\/span><span dir=\"ltr\" role=\"presentation\">contravenes or fail to comply with any provisions of these
