Patel and Gauri Godse, JJ. disposed of an appeal which was preferred by ISKCON (International Society for Krishna Consciousness) Bengaluru aggrieved by the observations that this well-known trademark (ISKCON) is exclusively associated with the original Plaintiff (\u201cMumbai ISKCON\u201d) and, by necessary implication, that Mumbai ISKCON is sole and exclusive registered proprietor of the mark in <\/span><i><span data-contrast=\"auto\">International Society for Krishna Consciousness v. Iskcon Appaeral Pvt. Ltd<\/span><\/i><span data-contrast=\"auto\">., <\/span><a href=\"http:\/\/www.scconline.com\/DocumentLink\/W7VDxXzz\"><span data-contrast=\"auto\">2020 SCC OnLine Bom 729<\/span><\/a><span data-contrast=\"auto\">.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:200,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><span data-contrast=\"auto\">The Court remarked that the appellant was not a defendant to the above<\/span><span data-contrast=\"auto\">&#8211;<\/span><span data-contrast=\"auto\">mentioned suit, the order in question obviously <\/span><b><span data-contrast=\"auto\">cannot bind<\/span><\/b><span data-contrast=\"auto\"> Bengaluru ISKCON. The Court further clarified that in its <\/span><a href=\"https:\/\/www.scconline.com\/blog\/post\/2020\/06\/29\/bom-hc-iskcon-declared-as-a-well-known-trade-mark-satisfies-tests-requirements-laid-down-in-trade-marks-act\/\"><span data-contrast=\"auto\">previous decision<\/span><span data-contrast=\"auto\">,<\/span><\/a><span data-contrast=\"auto\"> \u00a0the observations of the Single Judge were not to be construed as finally determining any claims or contentions that the appellants may have in regard to proprietorship of the mark, as also whether theirs is a claim of exclusive proprietorship or of a right of concurrent user. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:200,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\"><b><span data-contrast=\"auto\">&#8220;<\/span><\/b><b><span data-contrast=\"auto\">Those contentions are left open for the appropriate proceedings<\/span><\/b> <b><span data-contrast=\"auto\">before any forum including, we clarify, before the Registrar of<\/span><\/b> <b><span data-contrast=\"auto\">Trademarks. The Registrar of Trademarks, is therefore, bound by<\/span><\/b> <b><span data-contrast=\"auto\">the finding that ISKCON is well-known mark.
