{"id":270317,"date":"2022-07-18T18:00:24","date_gmt":"2022-07-18T12:30:24","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=270317"},"modified":"2022-07-29T16:36:59","modified_gmt":"2022-07-29T11:06:59","slug":"ministry-of-consumer-affairs-notifies-andhra-pradesh-consumer-protection-direct-selling-rules-2021","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/07\/18\/ministry-of-consumer-affairs-notifies-andhra-pradesh-consumer-protection-direct-selling-rules-2021\/","title":{"rendered":"Andhra Pradesh Consumer Protection (Direct Selling) Rules, 2021"},"content":{"rendered":"<div style=\"line-height: 150%;\">\n<p style=\"text-indent: 18pt; margin-bottom: 3%; text-align: justify;\">On 15-07-2022, the Consumer Affairs, Food &amp; Civil Supplies Department, Andhra Pradesh has notified AP Consumer Protection (Direct Selling) Rules, 2021 to define direct selling entity, cooling off period, money circulation scheme, etc.<\/p>\n<p style=\"text-indent: 18pt; margin-bottom: 3%; text-align: justify;\">Applicability: The Rule is applicable to all goods and services bought or sold through direct selling, and also applies to direct selling services which is not established in India.<\/p>\n<p style=\"text-align: justify;\"><b>Key Points<\/b>:<\/p>\n<ol style=\"text-align: justify;\">\n<li><span style=\"font-weight: bold;\">Maintenance of Records<\/span>: Every direct selling entity must maintain its record, either manually or electronically and required the documents like Certificate of Incorporation; Memorandum of Association (MoA) and Articles of Association (AoA), GST Returns, Income Tax Returns, Balance Sheet and Audit report etc.<\/li>\n<li><b>Obligation of Direct Selling Entity<\/b>\n<ul style=\"list-style-type: disc;\">\n<li>direct selling entity include companies incorporated under <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002766251\">Companies Act, 2013<\/a>; partnership firm registered under <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002752440\">Partnership Act, 1932<\/a> or a Limited Liability Partnership (LLP) registered under <a href=\"https:\/\/www.scconline.com\/DocumentLink.aspx?q=JTXT-0002831279\">Limited Liability Partnership Act, 2008<\/a>.<\/li>\n<li>have a registered office within India.<\/li>\n<li>maintain proper and updated website with all relevant details of that entity. All information provided in website duly certified by a Company Secretary (CS).<\/li>\n<li>have a prior written contract with its direct seller and also, ensure the verified identities, addresses, and documents of a direct seller.any misleading, deceptive or unfair trade practices are not used.<\/li>\n<\/ul>\n<\/li>\n<li><b>Duties and Obligations of direct selling entity<\/b>: Direct seller must ensure that\u2014\n<ul style=\"list-style-type: disc;\">\n<li>actual product delivered to the buyer matches with the description of the given product.<\/li>\n<li>direct seller shall not visit a consumer&#8217;s premises without ID card and prior appointment.<\/li>\n<li>terms of the offer are clear, so that the consumer know the exact nature of offer being made.<\/li>\n<li>goods and services offered are accurate and complete with regard to price.<\/li>\n<li>right of return offered by that entity shall be in writing.<\/li>\n<\/ul>\n<\/li>\n<li>Person of unsound mind or who is convicted, or bankrupt during the last five years cannot be engaged in the business of direct selling.<\/li>\n<\/ol>\n<hr \/>\n<p style=\"text-indent: 18pt; text-align: justify;\"><strong><span style=\"color:
