{"id":269870,"date":"2022-07-10T09:58:18","date_gmt":"2022-07-10T04:28:18","guid":{"rendered":"https:\/\/www.scconline.com\/blog\/?p=269870"},"modified":"2022-07-11T12:18:24","modified_gmt":"2022-07-11T06:48:24","slug":"uttaranchal-high-court-allows-stay-on-government-order-banning-animal-slaughter-on-the-occasion-of-bakar-eid-in-mangalore","status":"publish","type":"post","link":"https:\/\/www.scconline.com\/blog\/post\/2022\/07\/10\/uttaranchal-high-court-allows-stay-on-government-order-banning-animal-slaughter-on-the-occasion-of-bakar-eid-in-mangalore\/","title":{"rendered":"Uttaranchal High Court allows stay on Government order banning animal slaughter on the occasion of Bakra Eid in Manglaur"},"content":{"rendered":"<p style=\"text-align: justify;\"><strong>Uttaranchal High Court: <\/strong>A Division Bench of Vipin Sanghi, C.J. and Ramesh Chandra Khulbe, J., allowed this writ petition imposing a stay, for a day, on Government order banning animal slaughter in Haridwar district.<\/p>\n<p style=\"text-align: justify;\">This writ petition was moved by one Faisal Hussain as an intervener and pleaded to allow slaughter of animals in the legally permitted slaughterhouses which already existed in the Manglaur<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> Municipality area as the festival of Eid- al- Adha (\u2018Bakra &#8211; Eid\u2019) is about to be celebrated on 10-07-2022.<\/p>\n<p style=\"text-align: justify;\">The intervener contended that in the town of Manglaur, there are 87% Muslims. The effect of the Government order dated 03-03-2021 was that when the festival of Bakra Eid was celebrated, animals were sacrificed in the streets. Apart from this, an abattoir, a slaughtering house, has already been constructed under the Public-Private Partnership Model with all requisite permissions. It was also stated that these legally approved slaughterhouses were not operational because of the blanket ban imposed by Government order dated 03-03-2021 restraining slaughter of animals in entire Haridwar district.<\/p>\n<p style=\"text-align: justify;\">The Court allowed animal slaughter on the upcoming Bakra Eid on 10-07-2022, because it is an essential religious practice in Islam.<\/p>\n<p style=\"text-align: justify;\">The Court directed interveners to ensure that no sacrifice should be made within the compound of an abattoir, and not outside their residences.<\/p>\n<p style=\"text-align: justify;\">The Court also directed the Municipal Board, Manglaur, District Haridwar, to make necessary arrangements at the abattoir on Bakra Eid on 10-07-2022.<\/p>\n<h4 style=\"text-align: justify;\"><span style=\"color: #800000;\">[Iftakhar v. State of Uttarakhand, (PIL) No.44 of 2021, decided on 07-07-2022]<\/span><\/h4>\n<hr \/>\n<p style=\"text-align: justify;\"><a href=\"#_ftnref1\" name=\"_ftn1\">[1]<\/a> <span style=\"color: #ff0000;\"><strong>Ed. Note:<\/strong> <\/span>The Judgment of the Court mentions \u2018Mangalore\u2019 which falls in the State of Karnataka.
