This Amendment seeks to amend <a href=\"http:\/\/www.scconline.com\/DocumentLink\/8v9igwoo\">International Financial Services Centres Authority (Finance Company) Regulations, 2021,<\/a> with the aim of defining the certification process and updating activities permitted to be carried out by the Finance Company under<span style=\"font-weight: bold;\"> IFSCA<\/span>. These regulations will come into force with immediate effect.<\/p>\n<p style=\"font-weight: bold;\">Key Amendment:<\/p>\n<ul style=\"margin-left: 18pt;\">\n<li>With the modification of <span style=\"font-style: italic;\">Regulation 3<\/span>, Entity which intends to operate as a <span style=\"font-weight: bold;\">Finance Company or Finance Unit<\/span>, in International Financial Services Centres (IFSCs), may not be required to seek a fresh certificate if it has already obtained the certificate of registration under any other legal framework under the Authority.<\/li>\n<li>The activities that are permissible to be carried out should be covered under <span style=\"font-style: italic;\">Regulation 5<\/span>.<\/li>\n<li>Governed by the provisions of <a href=\"http:\/\/www.scconline.com\/DocumentLink\/A5aqjfDv\">Companies Act, 2013<\/a>, Finance Company may be set up as an incorporated subsidiary\/joint venture in its home jurisdiction.<\/li>\n<li><span style=\"font-style: italic;\">Regulation 5(1)<\/span> is amended to revise the <span style=\"font-weight: bold;\">Permitted Core Activities<\/span> and <span style=\"font-weight: bold;\">Permitted Non-Core Activities<\/span> by the Authority.<\/li>\n<li><span style=\"font-style: italic;\">Regulation 10A<\/span> is inserted to remove difficulties and relax strict enforcement of the regulations, explained as under,\n<ol>\n<li>For the removal of any difficulty in the application or interpretation of the provisions, the Authority may, through guidance notes or circulars, issue clarifications.<\/li>\n<li>Authority may, for the development of the financial market, relax the strict enforcement of any requirement of these regulations regarding payment of a prescribed fee.<\/li>\n<\/ol>\n<\/li>\n<\/ul>\n<p style=\"text-indent: 18pt;\"><strong><span style=\"color: #000080;\">*Shubhi Srivastava, Editorial Assistant has reported this brief.<\/span><\/strong><\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>On 1-7-2022, International Financial Services Centres Authority (IFSCA) notifies International Financial Services Centres Authority (Finance Company) (Amendment) Regulations, 2022.
